신종감염병 대응체계 개선을 위한 공법적 고찰

국문 초록

인류는 매 시대 새롭게 등장하는 감염병에 맞서 투쟁해 왔다. 지구 생태계의 변화, 환경오염과 국제여행의 증가, 바이러스 변이, 수인성 전염병 등 복합적 요인을 바탕으로 신종감염병의 출현은 앞으로 더욱 빈번해질 것으로 예측되며 감염병의 양상 또한 불확실성이 높은 형태로 진화할 것으로 전망되고 있다. 우리나라는 사스와 메르스 신종인플루엔자 등 연이은 감염병 유행사태를 겪으며 음압격리 병상을 포함하여 보건의료 인력, 장비, 물자, 시설 등을 확충, 상당한 수준의 위기대응능력을 배양하였다는 평가를 받았으나 올해 초 새롭게 발생한 신종 코로나바이러스 “코로나 19”사태에 직면하여 노출된 여러 문제점은 공중보건 비상사태의 대응능력이 이전에 비교하여 개선되었을 뿐 여전히 상당 부분의 보완이 필요함을 극명하게 보여주었다. 코로나 19가 걷잡을 수 없는 속도로 확산됨에 따라 사회적 재난으로서 감염병 사태에 대한 국가의 적극적 개입의 필요성이 제기되면서 최근 국회는 ｢감염병의 예방 및 관리에 관한 법률｣을 중심으로 ｢의료법｣, ｢검역법｣ 등 관계 법령을 일부 개정하여 감염병 대응 및 관리체계를 재정비하였으며 사회적 재난인 감염병으로부터 국민의 생명 및 안전을 수호하고, 그 유행수준을 우리 보건의료체계가 감당할 수 있는 수준으로 관리하기 위해 각종 강제조치를 신설하기에 이르렀다. 본 논문은 코로나 사태로 개정･신설된 ｢감염병 예방 및 관리에 관한 법률｣ 및 ｢의료법｣, ｢검역법｣ 조항들을 평가하고, 사회적 재난으로서 감염병 사태에서 국가의 기본권 보호의무의 법적 근거와 그 정도에 관하여 논증하여 향후 새로운 감염병의 발생사태에서 국민의 생명 및 안전 보호의 실효성 확보 방안에 관하여 고민하고자 한다.

영문 초록

Human beings have fought against the emerging infectious diseases of every era. Based on complex factors such as changes in the global ecosystem, increased environmental pollution and international travel, virus mutations and waterborne diseases, the appearance of new infectious diseases is expected to become more frequent in the future, and the pattern of infectious diseases is also expected to evolve into a form of high uncertainty. Although Korea has been evaluated to have developed a considerable level of crisis response capabilities by expanding its health and medical personnel, equipment, supplies and facilities, including negative pressure isolation beds, in the wake of a series of outbreaks of the new coronavirus “Corona 19” earlier this year, many of the problems exposed in the face of the new coronavirus have clearly shown that the responsiveness of public health emergencies has improved previously but still needs to be supplemented. With the spread of Corona 19 at an uncontrollable pace, the National Assembly recently reorganized its response and management system for infectious diseases by partially revising related laws, including the Medical Service Act and the Quarantine Act, focusing on the Infectious Diseases Prevention and Management Act, to protect the lives and safety of the people from infectious diseases, and to manage the epidemic level at a level that the Korean health care system can handle. This paper evaluates the provisions of the Infectious Diseases Prevention and Management Act, the Medical Service Act, and the Quarantine Act, and discusses the legal basis and extent of the nation s basic rights protection obligations in infectious diseases as a social disaster to consider how to secure the effectiveness of people s life and safety protection in the event of new infectious diseases in the future.
