국문 초록

공수처에 대한 관심이 다시 고조되는 가운데, 공수처에 대한 긍정적인 입장과 부정적인 입장이 첨예하게 대립하고 있는 현실이다. 일부에서는 공수처안이 중국의 국가감찰위원회와 유사하여 정적 제거용으로 사용될 우려가 있다는 주장도 나오고 있다. 공수처에 대해 많은 선행연구가 외국제도를 소개하고 있으나 홍콩의 염정공서, 싱가포르의 탐오조사국 정도가 주로 언급되고 있는 실정이다. 성공한 공수처를 모델로 삼아서 벤치마킹하는 것도 필요하지만, 성공적이지 못한 공수처를 반면교사 삼아서 공수처의 문제점을 미연에 방지하려는 노력도 필요하다고 본다. 공수처는 어떤 조건에서 실패하는가? 이 연구질문에 답하고자 본고는 사례로 중국과 인도의 부패방지 수사기구를 살펴보았다. 중국의 중앙기율검사위원회는 강력하지만 인권침해의 소지가 크며 당에 종속되어 있다. 인도의 중앙감시위원회는 독립적이나 수사에 대한 권한이 약하다. 두 나라의 사례에서 볼 때, 공수처의 실패는 독립성의 부재와 제한된 권한에 기인한다.

영문 초록

In South Korea, the debate related to building the anti-corruption investigative agency heats up. Some experts argue that bills related to establishing the anti-corruption investigative agency in Korea are similar to the acts in China. While many studies in Korea introduce the anti-corruption investigative agencies in Hong Kong and Singapore, it is difficult to find a good study that deals with unsuccessful cases. What factors generate the failure of the anti-corruption investigative agency? To answer this question, this study investigate China and India cases. While the Central Commission for Discipline Inspection of China has a lack of independence, the Central Vigilance Commission of India has a lack of power. The Indian leaders refuse to build a strong anti-corruption agency that may impede their ability to protect political allies. The Chinese leaders use anti-corruption policies as a punishment against opponents to increase their power in the party and the power of the party. This study assets that the success of building the anti-corruption investigative agency is based on citizen s will to fight corruption and that the purpose of the anti-corruption investigative agency should be to curb grand corruption.
