국문 초록

한국의 FTA 원산지규정은 각각의 FTA마다 상이하며 이는 FTA 원산지규정을 준수해야 하는 수출입기업의 어려움으로 작용하고 있다. 또한 원산지규정 자체의 엄격성과 상이함으로 인하여 FTA를 통해 관세장벽을 철폐하였지만 원산지규정이 새로운 무역장벽이 되는 문제가 대두되고 있다. 이러한 복잡한 원산지규정은 세관당국과 수출입기업관 많은 분쟁을 야기하게 되어 FTA 활용의 어려움을 야기 하고 있다. 이에 본 연구에서는 국내의 최근 조세심판원의 FTA 원산지규정 분쟁사례를 원산지증명서, 원산지 결정기준, 원산지검증에 걸쳐서 분석하였다. 이를 통해 원산지규정을 준수하여 FTA 특혜관세를 적용 받기 위해 원산지 결정기준에 대한 이해와 원산지증명서의 정확한 발행이 수출입기업에게 요구되어 진다. 또한 상대국의 원산지검증에 대한 대응을 위해 증빙자료의 확보와 정부의 행정적 지원도 필요해 보인다.

영문 초록

Korea s FTA Rule of Origin are different for each FTA, which is the difficulty of import-export companies that must comply with FTA rules. In addition, due to the strictness of the Rule of Origin, the tariff barriers were eliminated through FTA, but the problem of origin is becoming a new trade barrier. These complex Rule of Origin cause many disputes between the customs authorities and the import and export enterprises, which are obstacles to the use of FTAs. Therefore, in this study, we analyzed the dispute case of FTA rules of origin of tax referees in Korea. those dispute case were the certificate of origin, the determination of Rule of Origin, and the verification of origin. In order to comply with the rules of origin and to apply FTA preferential tariffs, it is necessary for export - import companies to understand the rules for determining origin and to issue accurate certificates of origin. It is also necessary to secure evidence documents and administrative support from the government in order to respond to the verification of origin of the other country.
