국문 초록

리니언시제도(leniency program)는 부당공동행위에 참여한 기업이 그 사실을 공정거래위원회에 자진하여 신고하거나 조사에 협조하는 경우에 시정조치나 과징금 등 제재의 수준을 감면하는 제도이다. 이 제도를 활용함으로써 범죄행위를 저지른 기업들 무거운 처벌을 감면받을 수 있고, 공정거래위원회는 카르텔에 대한 조사 및 입증책임의 부담을 상당부분 덜어낼 수 있게 된다. 이를 통하여 갈수록 은밀해지고 교묘해지는 카르텔을 효율적으로 적발하고, 기업들의 카르텔에 대한 유혹을 억제할 수 있다. 그러나 카르텔을 한 자에 대하여 자진신고를 이유로 제재를 감면해 주는 것에 대해서는 공평의 관점 내지는 국민 일반의 법감정의 측면에서 바라보았을 때 부정적인 시각도 많다. 그럼에도 불구하고 이 제도는 현재 활용도가 매우 우수하고 우리나라에서 가장 효율적인 카르텔 적발 및 억제제도로 평가받고 있다. 본 논문에서는 리니언시제도의 현황과 문제점을 다루고자 한다. 특히 대형 보험회사에 비해 상대적 약자라고 할 수 있는 중소보험회사가 리니언시제도를 효과적으로 활용할 수 있는 방안을 중점적으로 다루었다. 또한 최근 공정거래위원회의 전속고발권 폐지 논의와 관련하여 리니언시제도를 보완하기 위한 제도적 방안도 본 논문에서 다루고자 한다.

영문 초록

The leniency program is a system that reduces the level of sanctions, such as corrective actions or fines, when a company participating in an unfair joint act voluntarily reports the fact to the Fair Trade Commission or cooperates with an investigation. By utilizing the system, companies that commit criminal acts can be exempted from heavy penalties by reporting them on their own, and the Fair Trade Commission will be able to ease much of the burden of investigating and proving cartels. By doing so, Through this process, the company effectively identifies the increasingly subtle and subtle cartels and suppresses the temptation to do so. However, there are many negative views when viewed from a fair perspective or from the perspective of the general public s legal sentiment. Nevertheless, the system is now recognized as the most efficient detection and suppression system in the country. In this paper, I am going to deal with the current situation and problems of the leniency program. In particular, I want to focus on ways to effectively utilize the leniency program by small and medium-sized insurance company, which can be called the relative underdog compared to large insurance company. In addition, the abolition of the Fair Trade Commission s exclusive right to file complaints is currently under discussion, in which case institutional measures to supplement the leniency program are also to be addressed in this paper.
