고령사회와 고령자고용법의 과제

국문 초록

세계에서 가장 빠른 속도로 고령사회로 진입하고 있는 우리나라는 고령자고용을 촉진하고 확보하는 것은 고령자를 부양하기 위한 사회적 부담을 줄이면서 고령사회를 대비하는 중요한 선결과제라는 점에서 이에 관한 노동법적 과제를 검토하였다. 검토결과 고용관계의 성립전개종료에서 연령을 기준으로 하지 않는 것은 국민의 기본권을 실현하기 위한 당면과제이며 고령사회로 진입하고 있는 우리가 준비하여야 할 고용정책의 기본방향이라 제안하였다. 이에 종래의 ‘연령에 의한 채용관행’, ‘연령에 의한 고용관리’, ‘연령에 의한 해고(정년퇴직)’ 등, 연령을 기준으로 하는 고용관행을 가능한 한 연령에 의거하지 않는 제도에의 이행을 준비하고 실천하여야 할 법적 과제를 검토하였다. 또한 고령자관련법의 개선방향에 대해서는 ‘고령자고용’과 ‘생활보장’을 위한 법체계를 구축하는 것이 필요하며, 이른바 ‘고령자법’을 체계화할 것을 주장하였다. 고령자법을 체계화함에 있어서는 고령자를 고령자라는 테두리에 가두지 않고 사회구성원으로서 건강하게 생활할 수 있도록 자립을 지원하는 것이 중요한 과제라는 점을 강조하였고, 따라서 고령자가 자립할 수 있도록 각 단계에서 법과 제도가 적정하게 운영되도록 정비하는 것은 우리의 과제라는 점을 밝혔다. 그리고 고용유지는 반드시 가득(稼得)노동뿐만 아니라 자원봉사와 결합한 가치있는 활동에 참여하는 것이 확대되어야 한다는 점을 제시하였다.

영문 초록

As the fastest aging society all over the world, it is the very important issue in Korea that the government should have to encourage the employment of the elderly for reducing the expenses and burden of the society. This paper focused on the enrichment of employment of the elderly which is the key factor for the preparing for the aging society from the point of the view of labor law. The exclusion of age discrimination from the agreement of labor contract to the conclusion of the labor contract is the urgent and the heart of the problem on realizing the fundamental rights of people while just entering the gate of aging society. In this study, labor market practice about the age-based employment, age-based job management, and mandatory retirement system under the age limit were investigated. Then, the issues of law about the institutional measures for the new labor market culture which is not based on the age discrimination were fully considered. To improve and guide manual for the legislation and legal support for the elderly workers,employment and welfare benefits for livelihood protection are the most important factors. There are two basic principle on the aged employment system of law. One is the rule of equality, the other is the rule of protection for the minority. Specifically, the elderly should not be discriminated against because of their age in the labor market. And, The government must take effective actions to protect the employment of elderly workers. Besides, the policy for maintaining the employment should accompany not only salaried jobs but also the volunteer based participation of the elderly.
