한중일 3국의 WTO 분쟁해결에 관한 연구

국문 초록

본 논문은 그 동안 WTO 분쟁해결제도를 통해 제기된 한국, 중국, 일본 3국의 직접 관련 분쟁을 함께 분석하고 있다. 이들 3국이 관련된 분쟁을 통합해서보면 미국과 EU에 이어 세 번째로 많지만 그들의 성과는 다소 만족스럽지 못한 것으로 판단된다. 즉, 이들 3국이 참여한 분쟁은 패널절차로 이행되는 경향이 높았으며 WTO의 양대 세력이라 할 수 있는 미국과 EU를 상대한 경우 특히더 그러했다. 그러나 그들을 상대로 한 분쟁에서 한중일 3국이 만족스러운 성과를 얻지 못한 반면 미국과 EU는 자신들이 만족한 성과를 얻은 것으로 분석된다. 서술적 통계분석과 더불어 계량적 모형을 이용한 본 논문의 실증분석 결과는 WTO 다자체제에서의 한중일 3국의 공조 필요성을 나타낸다. 즉, WTO 협정을 우루과이라운드 협상의 결과물로 볼 때 미국이나 EU에 비해 분쟁해결에서 한중일 3국의 성과가 미흡한 것은 현행협정의 내용이 그만큼 불리하다는 증거가 될 수 있다. 따라서 비록 현재는 중단된 상태이지만 DDA 협상이 재개될경우 한중일 3국의 협력이 필요하며 이는 또한 지역패권을 둘러싼 미⋅중의 대결구도 틈새에 놓인 한국의 입장에서는 유용한 돌파구가 될 수 있다.

영문 초록

This paper analyzes the dispute settlements of Korea, China, and Japan since the launch of the new litigation system of the WTO. Although they all have been active participants of the dispute settlements with combined total numbers of disputes ranked the third behind the US and the EU, their performance seemed to be unsatisfactory. That is, in this paper, Korea, China, and Japan were shown to take proportionally more cases to the panel process against the US and the EU. Futhermore, the US and the EU were proved to have more favorable outcomes against 3 countries, while they were less successful against two superior powers in the current WTO regime. Considering the fact that WTO agreements were the outcome of the Uruguay Round negotiations, the poor dispute settlement performances of Korea, China, and Japan suggested that their cooperation would be needed in the future multilateral trade negotiations. Although the DDA negotiation has currently been stalled, if resumed, it would be an opportunity for Korea to avoid political as well as economic dilemma in between China and the US, the two super powers seeking dominant role for the regional hegemony.
