국문 초록

이 논문은 한국 사법 문화에 관한 사례 연구이다. 논의되는 사례는 2013년 5월 30일 선고된 헌법재판소 2009헌마514이며, “[판시사항] 가. 사립대학인 ○○학당의 법학전문대학원 모집요강이 헌법소원심판의 대상인 공권력의 행상에 해당하는지 여부 나. 교육부장관이 학교법인 ○○학당에게 한 법학전문대학원 설치인가 중 여성만을 입학자격요건으로 하는 입학전형계획을 인정한 부분이 남성인 청구인의 직업선택의 자유를 침해하는지 여부”이다. 이 사건은 입학전형계획에 대한 대학의 자율성과 이 대학의 모집요강을 허가해준 교육부의 인가처분이 지닐 수 있는 직업선택의 자유 침해의 대립하는 권리 중 어떤 권리가 우선하는지에 관한, 또는 이 두 권리가 어떻게 균형을 이룰 수 있는지에 관한 판결로 랜드마크 판결이 될 가능성이 있었다. 헌법재판소 재판관의 의견이 이와 같은 헌법소원심판을 바라보는 평범한 시민의 의견과 일치할 것이라고 여길 수는 없다. 그렇다고 하여도 앞으로 이 심판이 판례로서 여러 가지 역할을 할 것이 분명하다. 따라서 이 사건에 대한 판결이 지니는 윤리적 의의를 탐구하여 한국의 사법 문화에 대한 이해를 높이는 것이 중요하다. 이는 한 나라로서 우리의 사법 문화가 어디까지 와 있는지와 법적으로나 윤리/도덕적으로 우리가 향상시켜야 할 점이 있다면 그것은 무엇이지를 알려줄 것으로 기대한다.

영문 초록

This paper is a case study on legal culture in Korea. It discusses a Constitutional Court decision, 2009HyonMa514. The court attempts to strike the balance between the autonomy of a privately funded school in setting its admission policy, and an individual’s (or a group of their) freedom of the choice of occupation. To study this decision is an important step in recognizing the legal cultures in Korea, helping us to see where we stand as a nation, and also assisting us to realize what needs to be improved both legally and ethically. The court had to decide on the occasion, in which the school’s admission policy is set to exclude some students’ from being admitted to its law school, and thereby perhaps appears to infringe upon their freedom. This decision shall inform us what the court thinks about which takes precedents, or how to balance these fundamental rights. The study proceeds as follows. The Constitutional Court decision 2009HyonMa514 is presented (§2). Some landmark decisions of the United States are found to have some common features from an ethicist point of view (§3). The Constitutional Court decision is compared to the landmark decisions of section 3, and it is shown to fall short of becoming a landmark decision (§4).
