신변보호담당관의 탈북민 범죄 예방교육개선 방안 고찰

국문 초록

정부는 탈북민의 성공적인 사회정착을 위해서 거주지보호담당관, 취업보호담당관, 신변보호담당관, 민간단체 등을 통해 정착지원을 하고 있다. 하지만 ,탈북민은 재북(在北 )당시 잘못 체득한 법의식과 문화 등의 잔재로 인해 자본주의 사회에 적응하기란 쉽지 않다. 최근 탈북민 범죄가 언론을 통해 빈번하고 보도되고 있다. 일부 탈북민은 사회정착 과정에서 남북문화 차이, 경제적 어려움에 따른 생활고, 재북 가족에 대한 미안함과 향수 등이 중첩되는 과정에서 범죄환경에 노출되자 신변보호담당관 역할의 중요성이 사회적 관심사로 부상되고 있다. 그럼에도 탈북민 범죄와 관련한 연구는 탈북민 보호대책과 범죄통계 등에 대한 자료 접근과 수집의 한계로 미흡한 수준에 머물고 있다. 이러한 문제의식 하에, 이 글은 탈북민 범죄사례 분석을 통해 신변보호담당관의 탈북민 범죄 예방교육 개선방안으로 생활 밀착형 법률 교육, 인권·인성 교육, 범죄예방 교육 표준 강의안 지원, 치안환경 적응 교육프로그램 지원, 마약류 범죄예방 교육 등을 제언했다. 이러한 대책도 필요하지만 무엇보다 중요한 것은 탈북민 사회 스스로 범죄노출을 차단하는 의지를 가지고 실천하기 위한 자정의 노력이 필요하다는 것이다.

영문 초록

The government has been supporting the North Korean Defectors through residential care officers, employment protection officers, personal protection officers, and private organizations in order to ensure successful social settlement in South Korea. However, it is not easy for North Korean Defectors to adjust to the capitalist society due to the lingering legal consciousness and culture that they had learned during their stay in the North Korea. Recently, crimes committed by North Korean defectors have been reported frequently through the media. The importance of the role of the personal protection officer is emerging as a social concern as North Korean defectors commit crimes because of their feelings of sadness and longing for their families living in North Korea, cultural differences, and economic difficulties. Nevertheless, due to the limitations of police s access and collection on crime statistics data, research and policy establishment against the crimes committed by North Korea Defectors remains at an insufficient level. In this sense, this paper suggests several measures for the crime prevention education for North Korean Defectors through an analysis of crimes committed by Defectors. For this purpose, the police should provide Defectors with education on living laws, human rights, personality and prevention of drug crimes. In addition, it should be established a standard teaching plan for crime prevention education and supporting education programs for North Korean Defectors to adapt to the security environment. Most importantly, however, the North Korean refugee community needs to make efforts to act with the will to block criminal exposure on its own.
