공익사업을 위한 손실보상 제도의 개선방안에 관한 연구

국문 초록

본 연구는 공익사업을 진행함에 있어서 불가피하게 발생되는 손실보상에 대한 제도개선을 위해 주요변수를 도출하고 행위자 입장에서는 사업 기간 내에 효율적인 사업을 진행하고 수용자 입장에서는 손실보상의 합리성을 추구하기 위한 시사점을 제공하고자 연구의 체계를 사업인정단계, 수용재결 및 불복 단계로 구분하고 의사결정의 체계화와 합리화를 위한 방안으로 AHP 및 Fuzzy 분석을 통해 제도의 개선을 위한 우선순위 변수를 도출하고자 하였다. 분석결과 소분류에 대한 종합중요도는 대분류, 중분류의 비중 값을 각각 곱하여 도출하였으며 상위 5개 요인은 사업전개단계에서의 사업인식 측면 소분류 개별법상의 사업인정의제에 의한 공공성(토지보상법 제4조의 유형 모호) 변수가 AHP 종합 중요도 0.084, Fuzzy-AHP 보정 종합 중요도 0.165로 가장 중요한 요인으로 나타났다. 따라서 공익사업의 손실보상에서 행정권의 재량에 따라 사업의 방향성과 성공 여부가 결정되는 것으로 파악되어 공익사업의 사전준비 형태가 매우 중요함에 따라 법률에서 정한 집행과 더불어 수용자와의 협력방안이 보상자의 선정과 보상절차를 빠르게 진행할 수 있는 척도로 귀결된다.

영문 초록

The purpose of this study is to derive key variables to improve system for loss compensation that inevitably occurs in public service. Through this, the study aims to provide the implications for pursuing efficient business within the period of the business from the perspective of actors and pursuing the rationality of the loss compensation from the perspective of customers. To this end, the research system was divided into business approval stage, acceptance decision and dissent stage. In addition, AHP and Fuzzy analysis have identified the priority variables of the improvement plan for the systematization and rationalization of decision-making. The comprehensive importance for the small category was derived by multiplying the specific gravity values of the large and mid categories, respectively. In the top 5 factors, business recognition at the stage of project development and publicity (type ambiguity in Article 4 of the Land Compensation Act). at each AHP comprehensive importance 0.084 and Fuzzy-AHP adjusted comprehensive importance 0.165. In the loss compensation of public services, the direction and success of the project are determined by the discretion of the executive authority. Since the preliminary arrangements of public service preparation is so important, the cooperation with customers the along with law enforcement will be a way to speed up the selection and compensation process.
