국토계획법의 발전적 전개를 위한 법률과 제도에 관한 고찰

국문 초록

국토계획법은 난개발을 방지하고 환경친화적 국토이용체계를 구축하는 것을 목적으로 한다. 이를 위해 이 법은 제도개선과 함께 새로운 여러 제도를 도입하고 있다. 이 논문은 국토계획법의 분석·평가를 통해 법률과 제도의 발전적 전개방향을 제시하는 것을 주안점으로 한다. 이를 위해 이 논문은 국토계획법의 내용을 분석·정리하고, 난개발 방지를 위해 개편·도입한 법제를 검토하며, 이 법률의 발전방향을 제시하는 것을 내용으로 한다. 제1장은 국토이용관리의 변천에 대해 간략히 소개하고, 이 논문의 주안점과 작성방법에 대해 기술하고 있다. 제2장은 국토계획법의 제정목적과 배경을 설명하고 있다. 국토계획법은 ‘선계획, 후개발’원칙을 확립하고, 지속가능한 국토이용체계를 구축하는 것을 목적으로 한다. 그리고 이 법은 준농림지역의 난개발을 배경으로 하며, 건설교통부의 ‘국토의 난개발방지 종합대책’의 후속조치로 이루어졌다. 제3장은 국토계획법의 기본방향과 주요 개편법제의 의미를 분석하고 있다. 국토계획법은 국토공간 및 이용에 관한 법률의 체계정비, 국토계획체계의 개편, 도시계획기법의 도입, 난개발 방지를 위한 제도도입을 성과로 하고 있다. 제4장은 난개발방지를 위해 개편 및 도입한 법제 내용을 분석하고 있다. 국토계획법은 난개발방지를 위해 용도지역의 개편, 제2종지구단위계획의 도입, 개발허가제의 확대, 기반시설연동제의 도입을 내용으로 한다. 제5장은 국토계획법을 평가하고, 발전적 전개방향을 제시하고 있다. 국토계획법이 지니고 있는 문제점은 미래지향적 법률로 기대곤란, 계획내용의 복잡, 법률체계의 부족, 도시와 비도시의 이원적 체계 상존, 용도지역 구분의 비현실성, ‘선계획, 후개발’의 실현 가능성 의문 등을 들 수 있다. 따라서 국토계획법은 발전적 전개를 위해 계획중심의 토지이용제도로의 전환을 비롯하여 도시와 비도시의 통합, 개발허가제의 발전적 재구성, 개발이익환수에 의한 기반시설부담을 당면과제로 하고 있다. 제6장은 국토계획법의 장점과 성과를 다시 언급하고 보다 발전적으로 전개시키기 위해 당면과제의 해결에 힘써야 함을 강조하고 있다.

영문 초록

The purpose of the National Land Planning and Utilization Act [NLPUA] is to promote the public welfare and to enhance the quality of living environment through land utilization, development and preservation. Especially, it is to reorganize the previous systems and introduce new institutions in the planning and utilization of the national territory in order to prohibit improper development or urban sprawl and construct the environment-friendly system for planning and utilization of the national territory. Containing the analysis and estimation of NLPUA and new legal institutions to prohibit improper land development, this study starts from presenting developing directions of new institutions and NLPUA. In chapter 1, previous changes in the utilization and management of national territory are introduced in brief. The purpose and methods of this study are described. In chapter 2, legislative purpose and background of NLPUA are explained. As a measure to restrain improper development in the quasi-agricultural zone following the policy to prevent improper land development of the Ministry of Construction and Transportation, NLPUA aims to establish the principle of Plan first, Develop later and the sustainable land utilization scheme. In chapter 3, basic directions and significance of new institutions in NLPUA are examined. NLPUA is estimated to rearrange regulations and planning schemes for utilization in the national territory, to apply urban planning techniques to the national territorial planning, and to introduce measures to prohibit improper development. In chapter 4, the contents of the legal institutions reformed and introduced in NLPUA are analyzed. NLPUA contains reorganization of Specific-Use Areas, enlargement of the Development Permission System, and introduction of the Type-II District Unit Planning System and the Development Charge System for Infrastructure Cost-Share. In chapter 5, the estimation and developing directions of NLPUA are presented. NLPUA has problems with ideal and futuristic legal system, complicated planning schemes, the incomplete legal system, distinctive schemes between urban and rural areas, unfeasible plans in designating Specific-Use Areas, and the doubtful possibility of the Plan-led Development scheme. Accordingly, NLPUA is confronted with a number of issues, such as improvement of the plan-centered system for land utilization, integration of urban and rural areas, reconstruction of the Development Permission System, and rationalization of Infrastructure Cost-Share System for recapturing development gains. Chapter 6 summarizes advantages and excellent results of NLPUA and emphasizes that the problems mentioned above should be solved for the improvement of NLPUA.
