공증관과 문서고에 관한 교회법적 고찰

국문 초록

교회법전 제482-491조는 사무처장과 그 밖의 공증관과 문서고에 대해 다루고 있다. 교회법전 제482조에 따르면 교구청마다 사무처장이 선임되어야 하며 그의 주요 임무는 교구청의 기록 문서들을 정리하며 공증하는 일과 교구 문서고를 관리하는 일이다. 교회법전에서 사무처장의 직무는 교구청의 운영을 위해 매우 중요하게 제시되고 있다. 교구장 주교는 사무처장의 직무에 대한 구체적인 범위를 정하고 직무를 탄력적으로 운영할 수 있다. 그 밖의 공증관들의 직무는 교구장의 임명장에 달려 있다. 공증관들의 직무는 성직자에게만 국한되는 것은 아니며 필요한 경우에는 수도자나 평신도들에게도 개방되어 있다. 교회법전은 교구청 안에 문서고를 설치할 것을 의무로 규정하고 있다. 문서고의 법적 관리자는 사무처장이지만 최종 책임자는 교구장 주교이다. 법전은 비밀을 요구하는 문서들의 엄중한 보관에 대해서 특별히 강조하고 있다. 이러한 문서고는 일반 문서고와 다르게 별도의 장소에 설치하거나 아니면 최소한 잠금장치를 하여 자유로운 이동에 제한을 가해야 한다. 문서고의 엄중한 보관에 관한 법전의 가르침은 결국 문서들의 안전을 보장하기 위한 것이다. 공증관들과 문서고의 관리자들은 교회법전의 세부적인 가르침들을 잘 숙지하여 교회의 중요한 역사들이 잘 보관되도록 해야 할 것이다. 본당 사목구 주임과 법인들을 관리하는 특수사목 사제들 역시 본당과 기관의 문서고에 보관되는 문서들을 정확하게 기입하고 성실하게 보존하여야 한다 그들은 화재나 . 도난에도 주의를 기울여야 하며 역사적 중요성이 있는 문서들의 보관에는 각별히 신경을 써야 할 것이다.

영문 초록

The Code of Canon Law deals with the chancellor, other notaries and the archives in cann. 482-491. According to the can. 482 of the Code of Canon Law, “In each curia a chancellor is to be appointed whose principal office is to ensure that the acts of the curia are drawn up and dispatched, and that they are kept safe in the archive of the curia.” The chancellor s duties in the Code of Canon Law are presented with great importance for the operation of curia. The diocesan Bishop can establish a specific scope for the duties of the chancellor and operate the duties flexibly. The office of other notaries depends on the appointment of the diocesan Bishop. The office of notaries is not confined to clergy but also open to religious and laymen if necessary. The Code of Canon Law stipulates that a diocesan archive is required to be set up within the diocesan curia. The legal manager of the archives is the chancellor, but the final chief is the Bishop of the diocese. The Code of Canon Law places particular emphasis on the strict storage of confidential documents. According to the can. 489 § 1 of the Code of Canon Law, “In the diocesan curia there is also to be a secret archive, or at least in the ordinary archive there is to be a safe or cabinet, which is securely closed and bolted and which cannot be removed. In this archive documents which are to be kept under secrecy are to be most carefully guarded.” The teachings of the Code of Canon law on the Strict Storage of Archive are, after all, to ensure the safety of the archives. The chancellor and the other notaries and those who manage the archives should be well informed of the detailed teachings of the Code of Canon law so that important history of the church is well kept. A parish priest and priests who manage juridical persons in the Church shall also accurately fill out and faithfully preserve the documents stored in the archive. They will also have to pay attention to fire or theft and pay special attention to the storage of documents of historical importance.
