연구윤리 확립에 있어서 정부개입에 대한 미국 사례 분석및 한국에의 시사점

국문 초록

[연구목적] 본 연구는 미국의 연구윤리 확립과정에서 정부개입의 주요 쟁점들을 분석하고, 이를 바탕으로 한국에서 연구윤리 확립을 위한 정부개입 범위, 정부개입 방법, 정부개입의 수준 등에 대한 시사점을 제공하는데 있다. [연구방법] 연구 목적을 달성하기 위해. 미국에서 발표된 관련 법령, 보고서, 언론보도 자료 등 문헌과 사례를 분석하였다. [연구결과] 주요 연구결과는 첫째, 정부개입의 범위는 정부지원 연구는 물론 민간 부문에 대한 연구로 확대되어야 하며, 윤리뿐만 아니라 법적문제가 될 수 있는 사안에 대한 예방적 규제에 대해서도 정부개입이 필요하다, 둘째, 정부개입의 방법은 1차적인 책임을 대학 및 연구기관에 부여하는 간접적인 방식이 바람직하며, 학문분야별로 개입의 방식에 차별화를 두고, 규제와 지원의 균형일 이룰 수 있도록 하여야 할 것이다. 셋째, 정부개입 수준은 규제와 지원의 기본틀 마련까지만 개입하고 구체적인 세부 규제와 지원은 대학과 연구기관에 맡겨야 한다. 즉 목표및 원칙 제시에만 정부가 직접 개입하고 이행 기준 설정, 윤리위반 감시, 비윤리성 판단, 제재수준 결정 등에는 간접 개입해야 한다. [결론] 한국내 연구윤리 확립은 연구의 가치와 경쟁력을 확보하기 위한 기본적인 장치로 볼 수 있다. 연구윤리 확립 정책으로 정부의 단기적 획일적 개입은 지양되 어야 한다. 연구윤리의 범위와 정부개입의 적정성을 결정하는 데는 국제표준과 학문분야별 특성을 반영하여 연구자 및 연구기관의 참여를 확대해야 하며, 연구윤리 확보를 위해서는 연구자 및 연구기관의 자율적인 관리풍토의 조성에 초점을 두고 심각한 연구윤리 위반 사항에 대해서는 정부차원에서 대응해야 할 것이다.

영문 초록

[Purpose] This study attempted to search for adequate span, methods and degree of government intervention in academic society in order to secure research ethics. [Methods] or this purpose, it examined an American Case in depth and suggested directions of Korean government intervention on the basis of American experience. [Results] First, the span of government intervention needs to expand beyond government-sponsored researches into private organizationsponsored and independent researches. Second, the government needs to intervene in researcher’s activities, indirectly via university and institutes and discriminately on the basis of characteristics of academic disciplines. And the government intervention should maintain balance between regulations and assistances. Third, the government regulation should be confined to setting principles of regulation. The authority to set criteria of regulation, identify violations of them, and decide the kinds of sanction should be relegated to universities and institutes. The government assistance should be extended from compliance with regulation to fostering an atmosphere of ethical research, and be complementary to the efforts of universities and institutes. term and uniformed intervention. The government should not only consider international standards and characteristics of academic discipline, but also guarantee the participation of universities and institutes.
