국문 초록

민간조사업의 도입을 위한 정부와 국회에서 활발한 논의가 진행되고 있다. 특히, 2014년 3월 18일 국무회의에서 “신직업 육성 추진계획”을 통하여 새로운 일자리 창출을 위한 방안을 제시한 바 있다. 이 추진계획에는 민간조사업을 포함한 40개의 신직업의 육성 계획을 제시하고 있다. 민간조사업이 신직업의 창출과 경제적 효과의 극대화 등의 측면에서 필요성이 제시되기 까지 오랫동안 많은 논의들이 이루어졌었고, 그 이면에는 관리ㆍ감독 기관의 문제와 같은 정치적인 문제나 제도 시행 후 발생할 수 있는 개인정보 및 인권침해와 같은 불법행위들에 대한 관리방안 문제를 어떻게 해결해야 하는 가에 대한 합의가 이루어지지 않았다. 하지만 최근 윤재옥 의원이 발의한 「민간조사업의 관리에 관한 법률(안)」을 통하여 관리ㆍ감독 기관의 문제와 불법행위에 대한 관리 방안을 일정부분 해결해줄 수 있는 대안이 제시 되었다. 따라서 이 연구는 그간의 민간조사업의 제도적 정착을 위한 합리적인 관리 방안을 찾고자 하는 것이 연구의 목적이라고 할 수 있다.

영문 초록

An introduction of the private investigation business is being actively debated in the national assembly and the government. The state council s The initiative of promoting new career has especially proposed the plan of 40 job creations including the private investigation industry in March 18th, 2014. There have been much discussions whether the private investigation system could foster new careers and maximize economic benefits. Political issues such as malfunctioning of management agency and supervisory institution, and malfeasance issues on the possible invasion of individual privacy and violation of human rights after implementing the private investigation system, however, were quite controversial so the parliament did not have reached an agreement how to deal with these practical management matters. 「Act on administration of private investigation industry)」by a congressman Yoon Jaeok proposed an alternative which could seek sensible solution to management measures about malfunctioning and malfeasance of management agency and supervisory institution. The objective of this study might be, therefore, finding the resonable management practice for institutional settlement of private investigation system.
