국문 초록

우리나라 가계 총자산에서 큰 비중을 차지하는 건축물은 환경을 저해하는 생산품으로 인식되고 있다. 그러나 우리 인류의 삶에서 가장 기본적인 것이 의식주이며 의식주 중에서 가장 고도의 기술과 비용을 필요로 하는 것 건축물이다. 그에 따라 건축물의 생산과 관련하여 많은 법률들이 제정되어 있으나 생산과정-건설과정-에서 환경피해로 인한 많은 민원이 발생하는 실정이다. 따라서 이 논문은 건축물의 생산과정과 관련된 법제도, 특히 소음진동관리법 등을 검토하고 해당 법규들의 적용실태를 확인한 후에 환경분쟁사례를 검토함으로써 현재의 법 제도 개선방안을 모색하여 쾌적한 생활환경의 제공과 불필요한 민원비용을 방지를 통하여 궁극적으로 국민들의 생활을 보호하고 건축물 생산비용의 절감으로 도모하고자 한다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this study is to examine the legal system related to building production and to protect the environment and prevent unnecessary cost, so that the production of buildings can be made environmentally friendly and economical. (2) RESEARCH METHOD General information on the development of environmental rights and individual environmental laws were reviewed. And the status of applying the laws on construction site was examined and analyzed. In addition, the cases which were decided by Environmental Conflict Resolution Committee were examined and analyzed. (3) RESEARCH FINDINGS After reviewing the related law and the status of applying the law, the Noise and Vibration Act for the living environment should be supplemented by securing the practicability of individual environmental laws such as Environmental Impact Assessment Act, Noise and Vibration Control Act and Construction Technology Promotion Act considering Building Act related. And also, the laws as is should be interconnected to achieve the protection of the living environment. 2. RESULTS The purpose of the protection of the environment is to provide the comfortable living conditions. The environmental laws is not enough to regulate the industry activities which have different characteristics among industries. Especially for the construction industry, the law is difficult to be formalized because the characteristics of construction industry. Therefore for the construction industry, collaborative researched in various fields in terms of technical and/or institutional side should be required.
