국문 초록

러시아는 체제전환 이후 사회주의법 아래에서 국유화되었던 토지에 대한 개인의 소유권을 회복시키고 국가, 즉 연방 및 지방정부 소유의 토지에 대한 사유화를 진행해왔다. 그래서 오늘날 러시아에서 원칙적으로 개인이 토지에 대한 소유권을 취득하고 이를 자유롭게 사용･수익･처분하는 것이 가능하다. 그런데 현재 90% 이상의 토지를 여전히 국가가 소유하고 있다는 점에서 토지사유화가 저조함을 알 수 있다. 이러한 현상의 배경으로는 국가소유 토지에 대한 무상사용권을 광범위하게 인정하는 점, 사유화 절차가 복잡하고 비합리적이라는 점 그리고 토지 사유화를 위한 러시아 국내에 민간자본이 부족한 점 등을 들 수 있다. 토지 사유화의 걸림돌이 되는 이러한 사정이 정책적으로나 정치적으로 쉽게 바뀌기 어렵기 때문에 러시아에서 토지의 사유화는 앞으로도 계속해서 높지 않은 수준을 유지할 것으로 예상된다.

영문 초록

1. Contents (1) Research Objectives The purpose of this research is to examine the past history and current status of land ownership in Russia. Particular emphasis is placed on how after the dissolution of the Soviet Union land was privatized in the Russian Federation. Moreover, this research delves into the reasons for the slow process of land privatization during the past two decades. (2) Research method This research was carried out by conducting a legal analysis of Soviet and post-Soviet academic writings and legislative texts. Both Russian and Korean literature was referenced for this research. (3) Research findings The slow process of land privatization in Russia is due to legislative and political reasons. It is expected that the level of land privatization will remain low for the foreseeable future. 2. Results Under socialist law land ownership was abolished and in its place the right to use land was recognized. Land was the subject of public, not private law. After the fall of the socialist regime, land ownership was restored in Russia. The privatization of land was gradually carried out and the process is still ongoing even to this day. However the level of privatization remains low. This is mainly due to the wide recognition of the right to use land. Also the cumbersome and time-consuming process of privatization, as well as the lack of capital necessary for the purchase of state-owned land is proving to be a significant hindrance.
