국문 초록

남북간의 교류와 협력은 그 과정에서 불가피하게 여러 가지 법적 분쟁을 야기한다. 이러한 분쟁은 주로 계약 위반이나 불법행위로 인하여 발생하는데, 그 결과는 대부분 손해배상책임으로 연결된다. 향후 남북간에 교류와 협력이 활발해질 것으로 예상됨에 따라, 북한 손해배상법에 대한 연구는 이론적인 측면에서뿐만 아니라 실무에서도 매우 중요하다. 북한의 손해배상법을 이해하기 위해서는 먼저 손해배상과 관련한 북한법의 체계를 파악할 필요가 있다. 이 글의 목적은 손해배상과 관련한 북한법의 체계를 분석하고, 이를 남한의 손해배상 제도와 비교·검토하는데 있다. 공법과 사법이 구분된 남한에서 손해배상제도는 민사법의 영역인데 반하여, 그러한 구분이 없는 북한에서 손해배상제도는 민사법의 영역이면서 공법적 성격도 갖고 있다. 특히, 북한법은 위법행위에 대해서 민사책임과 형사책임 이외에 행정적 책임도 인정하고 있으므로, 북한에서 손해배상이 문제될 때에는 행정적 책임에 관한 내용도 같이 검토할 필요가 있다.

영문 초록

Inter-Korean exchanges and cooperation inevitably cause various legal disputes in the process. Such disputes are mainly caused by breach of contract or tort, and the results are mostly linked to compensation for damages. It is expected that exchange and cooperation between South Korea and North Korea will become more active in the future, so the study of North Korea s compensation laws is very important not only in theory but also in practice. In order to understand the North Korea s compensation law, it is necessary to first identify the system of the North Korea s compensation law. In South Korea, where public laws and civil laws are separated, the compensation system is the area of civil law, whereas in North Korea, without such distinction, the compensation system is the area of civil law and has a public nature. In particular, the North Korean law recognizes administrative liability in addition to civil liability and criminal responsibility for illegal acts. Therefore, if there is a problem of compensation for damages in North Korea, it is necessary to review administrative liability.
