제주형 기관모형 구성에 관한 연구

국문 초록

제주는 2006년 특별자치도 출범으로 분권적 지방자치의 선도 모델임은 분명하며, 지방자치의 목적이 주민의 삶의 질 향상과 지역발전에 있다. 지방자치의 모범 지역이 되기 위해서는 주민의 자치역량도 중요하지만 이양된 자치권한을 효율적으로 운용할 수 있는 제도적 장치에 대한 검토, 즉, 지방자치단체의 기관 구성이 상호 대등한 위치에서 균형 있는 견제와 비대칭으 로 인한 비생산적 갈등이 존재하지 않는지에 대한 검토가 필요하다. 이에 본 연구는 우리나라 지방자치단체의 기관구성 문제점을 제시하고 제주형 기관모형 구성에 관한 방향을 제시하였다. 기관모형의 예시로 첫째, 내각집행기관 형태이다. 통합방식에 의한 기관구성 형태로 집행기관과 지방의회간 통합되어 운영되지만 최고 의사결정기관인 지방의회(총회)를 두고 집행기관이의회와 분리된 내각형 방식의 변형된 통합운영 모델을 고려할 수 있다. 통합형 내각시스템 모델은 기본적으로 주민직선에 의하여 지방의회를 구성하고, 지방의회로 하여금 정치적 리더를 수장으로 선출하여 집행부를 구성하게 한다. 둘째, 시경영인(수석 행정관) 모델이다. 전문행정가에게 일상적 행정권한을 위임하여 처리하도록 하는 형태이다. 통합형 기관구성에 있어서도 전문시경영인을 도입할 수 있으며, 대립형 기관구성일지라도 지방의회가 정한 기준과 범위 내에서 행정서비스의 효율성을 책임지게 하는 방식이다. 제주가 우리나라의 특별한 지방자치의 선도적 역할을 수행하는 지역임을 감안할 때 제주지역 특성에 맞는 기관구성에 대해 단순한 논의를 넘어 실현가능한 대안을 탐색하는 것은 특별자치도의 취지에 부합하는 바람직한 정책 실험이 될 수 있다.

영문 초록

Launching as a special self-governing province in 2006. Jeju became a leading model of local self-government. The purpose of its self-government is improvement of life of residents and local development. It is true that, to be a model of local self-government, residents of the local government should have capacity to govern for themselves. But, it is also important for the local government to be equipped with institutional composition to efficiently manage self-governing power transferred from the central government. It is necessary to examine whether the organizations of the local government check each other, and whether there is unproductive conflicts caused by asymmetric relations. Accordingly, this study showed the problems of organizational arrangement of Korean local governments, and suggested the direction of the Jeju-type organizational arrangement. As an organizational arrangement model, first, there is the parliamentary executive type. It is integrative organizational arrangement where, while the executive branch and council are operated as an integrated body, there is the parliamentary cabinet type in which the executive branch and separate from council, the highest decision-making body. In the integrative cabinet system, council is constructed by the vote of residents, and council members choose the political leader, who forms the executive branch. Second, there is the municipal manager (top administrator) model. In this model, council members commission administrative power to professional administrator. The integrative organizational arrangement can adopt the special municipal manager. In the confrontational organizational composition, speical administrator can be appointed to provide administrative service with the stanbdards and scope set by the local council. Given the fact that Jeju is the province which leads local self-government, it can be a desirable policy experiment matching the status of Jeju as the special self-governing province to go beyond simple discussion on organizational composition suitable to local characteristics, and explore an achievable alternative.
