국문 초록

부동산의 감정평가에 있어 부합물과 종물의 판정은 매우 어려운 문제이나, 그동안 관련 연구가 미진하여 감정평가활동에 어려움이 많았다. 본 연구는 부합물과 종물의 판정기준을 제시 하는 것이 목적이다. 연구결과를 요약하면 다음과 같다. 먼저, 토지의 부합물 판정기준으로는 부합하는 물건이 건물인지 여부, 분리가능 여부, 타인의 권원에 의한 부합 여부가 있다. 둘째, 건물의 부합물 판정기준으로는 독립된 물건인지 여부, 분리가능 여부, 타인의 권원에 의한 부합 여부가 있다. 셋째, 종물의 판정기준으로 독립된 물건인지 여부, 소유자의 동일성 여부, 주물의 상용에 이바지 하는지 여부가 있다. 본 논문이 관련 연구를 활성화하는데 기여하고 나아가 감정평가활동의 기초자료로 활용되기 기대한다.

영문 초록

To determine compound and appurtenance in real estate appraisal is very difficult and there have been a lot of difficulties in appraisal activities due to the lack of related research. The purpose of this study is to present the standards to determine compound and appurtenance. The result of the study is as follows: First, the standards to determine of the compound of land is whether the compounding things are buildings, the compounding things can be separated, the compounding things are by another’s title. Second, the standards to determine of the compound of building is whether the building is independent or not, the compounding things can be separated, the compounding things are by another’s title. Third, the standards to determine the appurtenance is whether the thing is independent or not, the owner is same, the appurtenance contributes to the utility of main thing. It is expected that this paper contributes to the activation of the relevant study and be used as the base data for appraisal activities.
