디지털 통상규범 정립 지연 이유와 우리나라 디지털 통상정책에 시사점

국문 초록

디지털 기술의 발달에 따른 디지털 무역 확대는 무역에 소요되는 거래비용을 혁신적으로 낮춰 기존에 국제무역에서 소외되어 있던 중소기업, 스타트업, 개도국 등이 손쉽게 국제무역과 글로벌 가치사슬에 합류할 수 있도록 하고, 비교역재이던 교육이나 진료 등 서비스도 새롭게 무역의 대상이 되어 글로벌 차원의 무역 활성화에도 이바지할 것으로 보인다. 그러나, 여러 가지 도전과제도 낳았는데 대표적인 예가 서버를 해외에 두고 상품과 서비스를 공급하는 인터넷 기업의 예에서 보듯이 초국경성(boardless)으로 인해 특정 국가 정부가 가지는 규제 권한 및 과세권한이 무력화되고, 이에 따라 프라이버시 보호, 글로벌 기업의 경쟁 저해적 행위, 소비자 보호 등에 어려움을 겪게 되었다. 따라서 디지털 무역의 기회 요인을 극대화하고 도전과제에 적절히 대처하기 위해 글로벌 디지털 통상규범을 정립해야 할 필요성이 대두되었다. 그러나 WTO 차원의 디지털 통상규범 정립은 1998년 이후 20년 넘게 지연되고 있는데, 본 연구에서는 이렇게 지연되는 이유를 첫째, 디지털 무역의 승자독식 특징이 각국의 기술경쟁력과 시장규모에 따라 디지털 통상규범 마련을 위한 협상에 나설 유인에 다르게 영향을 미치는 점, 둘째 디지털 무역의 잠재적 부작용에 대한 안전장치(safeguards) 부재로 분석하고, 이를 토대로 우리나라의 통상정책에 대한 시사점을 도출한다.

영문 초록

The expansion of digital trade due to the development of digital technology is expected to help small businesses, startups, and developing countries, which have been excluded from international trade, join the global value chain easily, and enable services such as education and health care to be tradable services, promoting global trade significantly. However, many challenges have arisen. For example, internet platform companies that supply goods and services with computing facilities overseas are incapacitating the authority of individual government to impose regulation and taxation on their services, resulting in difficulties in protecting privacy, monitoring anti-competitive behavior of global companies, and consumer protection. Thus, it was necessary to establish a global digital trade rule to maximize the opportunities and appropriately cope with the challenges. However, the establishment of global digital trade rules in WTO has been delayed for over 20 years since 1998. This study identifies the reasons for such delays by i) analyzing the winner-takes-all feature of digital trade and its various impacts on the incentive of WTO member groups to participate a negotiation for the rule, and ii) the lack of safeguards against the challenges. Then this study draws important implications from the analysis to the Korean government on the digital trade policy.
