국문 초록

한일관계를 논함에 있어 일본의 식민통치에서 유래된 과거사문제들이 여전히 빼놓을 수 없는 주요 논제(論題)가 되고 있다. 핵심은 1965년의 한일 청구권협정으로 이 문제들이 해결되었는지에 관한 것이다. 한국정부는 반인도적 불법행위인 일본군‘위안부’문제는 청구권협정으로 해결되지 않았으며, 강제동원피해문제는 해결된 것으로 봐야 한다는 입장이다. 반면, 일 본정부는 ‘위안부’문제를 포함한 모든 사안이 협정으로 해결되었다는 주장을 굽히지 않고 있다. 본 논문은, 교섭기록에 대한 분석을 통해 위의 과거사 현안들이 청구권협정으로 해결되었는지를 논증하는데 그 목적이 있다. 교섭기록을 살펴보면, 한국정부의 주장이 타당한 것으로 보인다. 일본군 ‘위안부’문제는 피해자들의 ‘미수금’문제로 한차례 논의된 적이 있으나, 반인도적 불법행위의 개념으로 다루어진 적이 없으며, 따라서 청구권협정으로 해결되지 않았다고 볼 수 있다. 강제동원피해(미수금, 위로금 등)문제는 한국정부가 한일회담의 교섭 시작단계부터 ‘대일청구권요강안’ 8개 항목에 포함시켜 교섭 전 과정에서 주요 사안으로 다루었고, 청구권협정 부속문서인 ‘합의의사록’에도 최종적으로 해결되는 청구권(대일청구권요강)으로 포함되었다는 점에서 해결되었다고 보아야 할 것이다.

영문 초록

Issues originated from the Japanese colonial rule are still included in the major agenda in discussing the Korea-Japan relations. The topic is whether these issues were resolved by the Claims Agreement of 1965 or not. The Korean government s position is the Japanese military comfort women issue, inhumane and illegal atrocities, has not been resolved by the Agreement and the issue of the forced mobilization could be interpreted as resolved. However, the Japanese government claims that all issues had been thoroughly resolved by the Agreement. The goal of this paper is to verify whose argument is correct through analyzing the diplomatic records. The analysis of the historical records show that the Korean government s position would be reasonable because the comfort women issue was on the negotiation table just once when two countries discussed about unpaid wages of the mobilized labourers from Korea and never dealt as a matter of inhumane and illegal atrocities committed by Japan. The issue of forced mobilization, on the contrary, had been included in 8 items of claims that the Korean delegation submitted to its counterpart at the first meeting between two countries and discussed as a major agenda through the negotiation until the Agreement was finalized. Moreover, 8 items of Korea s claims were stipulated in the Agreed Minutes, one of the annexed documents of the Claims Agreement between the Republic of Korea and Japan.
