국문 초록

우리나라의 근대적 토지 소유경계는 1910년 일제에 의하여 시행된 토지조사사업과 임야조사사업에 의하여 전국토를 조사·측량하고 일필지별로 소유자와 경계를 사정(査定)하여 지적공부에 등록하여 현재에 까지 이르고 있다. 즉 우리의 토지 소유권을 나타내는 소유 경계는 지적공부에 등록되어 있으며, 특별한 하자가 없는 한 이에 등록된 경계를 법적 경계로 하고 있다. 그러나 최초로 종이도면으로 작성된 지적도는 오랜 기간이 경과됨에 따라 마모·훼손되고 재작성, 도면전산화 등의 과정을 거치면서 많은 왜곡이 발생하고 있으며, 이를 통한 도상경계를 지상에 복원 할 경우 많은 문제점을 지니고 있어 토지 경계로 인한 분쟁이 매년 증가하고 있다. 따라서 본 연구는 독일, 프랑스의 지적관련 공부와 소유경계의 등록 및 관리 방안 현황을 분석하고 우리나라의 지적공부 및 소유 경계의 등록 및 관리 개선 방안을 제시하고자 한다

영문 초록

The modern land ownership boundary of Korea was surveyed and surveyed nationwide by land survey project and forest survey project conducted by Japan in 1910, and the owner and boundary of each land were assessed and registered for intellectual study. have. In other words, the ownership boundary that represents our land ownership is registered in the cadastral study and, unless there is a special fault, the registered boundary is the legal boundary. However, as the cadastral map created with the paper drawings for the first time passes through a long period of time, many distortions occur due to wear, damage, re-creation, and computerization of drawings, and there are many problems The dispute over land boundaries is increasing every year. Therefore, this study analyzes the current state of registration and management of intellectual - related study and ownership boundaries in countries such as Germany and France, and suggests ways to improve registration and management of intellectual study and ownership boundaries in Korea.
