중국의 약품안전신용감독 입법에 관한 고찰

국문 초록

최근 들어 중국에서는 이른바 ‘가짜 백신’ 등을 비롯한 약품안전사고가 끊임 없이 발생하고 있어 약품안전문제가 사회문제의 중심으로 부각되고 있다. 가짜 약품 제조와 판매 등의 위법행위는 단지 일반 대중의 건강을 심각하게 해할 뿐만 아니라, 중국의 약품시장정보공개에 대한 결함 문제이기도 한다. 이러한 문제는 오늘날 약품안전감독과 관련하여 결함과 정보공개에 있어 심각한 문제이 다. 이처럼 전통적인 약품안전감독 방법이 그 국한성을 가지고 있어 약품안전감독 방법의 새로운 개혁이 필요하다. 약품안전정보감독의 방식은 전통적 감독방식의 국한성을 어느 정도 보완할수 있다. 약품안전신용감독이라고 하면, 일반적으로 약품감독부문이 약품시장의 주체에 대하여 약품안전신용정보를 기록, 평가, 공개, 응용 등을 하는 것을 말한 다. 이는 일종의 보호성, 지속성, 정확성, 협동성을 가진 새로운 감독방식으로, 약품안전사고를 예방하거나 즉시 발견할 수 있을 뿐만 아니라, 약품경영자의 신용에 대한 의식도 강화시키는 효과가 있다. 약품안전신용감독은 중국이 가진 특색으로 일종의 새로운 행정감독방식이다. 또 현재 행정당국이 주요지침으로 하고 있는 감독방식으로, 입법에서 뿐만 아니라 실무에 있어서도 발전을 위해 연구가 진행되고 있다. 그동안 중국은 행정전반에 있어 법치를 추진하고 있는데, 이러한 시각에서 약품안전신용감독이 반드시 입법화되어야 할 것이다. 본 연구에서는 약품안전심용감독을 중심으로 중국의 약품안전심용감독입법의 필요성과 가능성을 분석함으로서 약품안전심용감독과 관련한 기본입법에 필요한 구체적 내용을 제안한다. 이러한 제안을 통하여 약품감독부문의 개혁방안과 방식 및 신용감독입법의 체계를 확립함에 있어 도움을 주고자 한다.近年来，随着“假疫苗”等药品安全事件的不断曝光，药品安全问题已日益成为社 会关注的焦点。制售假药劣药等违法违规行为，不仅严重危害了民众身体健康，而且暴露了中国药品市场信用缺失问题。这与当前药品安全监管存在缺失和漏洞有较 大的关系。传统的药品安全监管方式具有局限性，药品安全监管方式亟需创新。 引入药品安全信用监管方式可以一定程度上弥补传统监管方式的局限。药品安全 信用监管是指药品监管部门对药品市场主体的药品安全信用信息开展的记录、评 价、公开和应用等活动。这是一种全覆盖、持续性、精准性、协同性的新监管方 式，不仅有利于预防和及时发现药品安全事件，而且有利于培养和增强药品经营者 的信用意识。 药品安全信用监管作为具有中国特色的一种新的行政监管方式，目前主要靠政策 引导，无论是立法还是实践均处于探索阶段，相关专门研究很少。在中国推进全面 依法治国的背景下，将药品安全信用监管纳入法治轨道是必然趋势。本文在界定药 品安全信用监管的基础上，分析了中国药品安全信用监管立法的必要性和可行性， 提出了中国药品安全信用监管基本法律制度设计的具体建议。通过研究，以期对药 品监管部门提升监管理念、改革监管方式、完善信用监管立法有所裨益，助力中国 药品监管信用体系建设。

영문 초록

With the constant exposure of fake vaccine and other drug safety incidents recently, drug safety has increasingly become the focus of social attention. Illegal activities such as producing and selling fake and inferior drugs have not only seriously endangered people s health, but also exposed the lack of credit in China s drug market. This has a great relationship with the absence and loopholes of drug safety supervision. The traditional way of drug safety supervision has its limitations and it is urgent to innovate. The introduction of drug safety credit supervision may make up for the limitation of traditional supervision to some extent. Drug safety credit supervision refers to the record, evaluation, disclosure and application of drug safety credit information of drug market subjects which are carried out by drug regulatory authorities. This is a new supervision method with full coverage, continuity, accuracy and synergy, which is not only conducive to preventing and timely discovering drug safety incidents, but also conducive to cultivating and enhancing drug dealers awareness of credit. The drug safety credit supervision, as a new administrative supervision method with Chinese characteristics, is mainly guided by policies at present. Both legislation and practice of drug safety credit supervision are in the exploring stage, and there are few relevant specialized studies. Under the background of China s promotion of rule of law, it is an inevitable trend to bring drug safety credit supervision into the rule of law. Based on the definition of drug safety credit supervision, this paper analyzes the necessity and feasibility of China s drug safety credit supervision legislation, and puts forward specific suggestions on the design of China s drug safety credit supervision legal system. Through the research, it is expected to be helpful for drug regulatory authorities to improve the regulatory concept, reform the regulatory mode, improve the credit regulatory legislation, and facilitate the construction of China s drug regulatory credit system.
