국문 초록

경험적･보편적 치료에서 환자 개인의 특성을 고려하는 치료로, 증상을 완화하는 치료에서 질병의 근본적 원인을 해소하는 치료로 보건의료의 패러다임이 전환되고 있다. 하지만 정밀의료의 경우 보건의료 빅데이터에 대한 규제가, 재생 의료의 경우 줄기세포치료 및 유전자치료에 대한 규제가 패러다임 전환과 충돌 하고 있다. 개인 식별 가능성을 둘러싼 보건의료 빅데이터 논란, 기존 의약품 인허가 체계의 적합성을 둘러싼 줄기세포치료제 논란, 그리고 생명윤리를 둘러싼 배아 대상 유전자치료 논란은 쉽게 해결될 기미를 보이지 않는다. 보건의료 패러다임의 전환에 앞서 기술뿐만 아니라 사회･윤리적 측면도 고려한 신중한 검토가 필요할 것이다. 보건의료기술의 발전에 따른 기존 규제와의 괴리 현상, 기술적 안전성에 대한 충분한 검토 및 사후 규제 강화, 전문가의 판단 및 사회적 합의에 대한 존중, 우리나라의 기술 경쟁력 등을 고려한 법제 개선 방향을 도출하여야 한다. 과거 항생제와 백신의 등장은 감염에 의한 사망률을 극적으로 감소시켰다. 보건의료 패러다임 전환의 결과다. 정밀의료와 재생의료라는 또 한번의 패러다임 전환을 앞두고, 우리 사회가 합리적인 규제 방안을 도출하는데 역량을 모아야 할 때이다.

영문 초록

Healthcare paradigms are shifting from empirical and universal treatment to care that considers each patient’s personal characteristics and from symptom-relieving care to the identification and solution of the main causes of health conditions. Note, however, that regulations on big data in healthcare — in the case of precision medicine — and legal restrictions on stem cell therapy and gene therapy for regenerative medicine are in conflict with the changing paradigms. Controversies over the individual identifiability of healthcare-related big data, suitability of the existing drug licensing systems for stem cell therapies, and ethical issues on embryonic gene therapies do not seem to be resolved easily. Prior to the change of the paradigms for healthcare, not just technical aspects but also social and ethical aspects should also be taken into full consideration. Ways to improve related laws should be sought after careful consideration of the gaps between the existing regulations and developing healthcare technologies, technical safety, stricter post-regulations, respect for judgment of experts and social consensus, technological competitiveness, etc. The emergence of antibiotics and vaccines has dramatically reduced the mortality rates of infection. This is a feat of the paradigm shift on healthcare. Facing another paradigm shift toward precision medicine and regenerative medicine, all available resources of our society should work together in exploring rational regulatory measures.
