교회의 통치권(사목권)과 평신도의 협력

국문 초록

오늘날 성직자가 가지고 있는 교회의 통치권(사목권, 관할권, 재치권)에 대하여 평신도들도 참여의 목소리를 높이고 있고 이로 인해 때로는 평신 도와 성직자 사이에 적지 않은 불목관계가 대두되기도 하고 불필요한 긴장관계가 형성되기도 한다. 과거에 성직자만의 고유한 전유물로 여겨져 왔던 교회의 통치권에 대한 참여의 소리가 평신도들 사이에서 나날이 거세 어지고 있는 것이다. 구 교회법전(1917년 법전)에서 교회의 통치권은 배타 적으로 성직자에게만 있었으며 평신도에게는 어떠한 방법으로도 그러한 권한의 행사에의 참여를 허용하지 않았던 반면에 현 교회법전(1983년 법전) 제129조 2항은 “평신도들이 교회 통치권의 행사에 법규범을 따라 협력할 수 있다.”라고 규정하고 있다. 현 교회법전에서 규정하고 있는 교회의 통치권에 대한 평신도들의 협력과 참여가 과연 어느 정도로 가능한지에 대한 법적인 범위와 한계를 살펴보고 또한 교회의 통치권에 관련되는 법조항들에 대한 연구를 통하여 현 교회법전 제129조 2항에 내포되어 있는 조항의 의미를 보다 구체적으로 알아보고자 한다. 본 연구를 통하여 성직자와 평신도가 교계의 질서 안에서 존재하는 서로의 법적인 위치를 파악하고 이를 토대로 교회의 통치권에 대한 서로간의 차이점과 한계점을 정확히 인식하여 소모적인 논쟁과 갈등을 줄여 각자의 자리에서 그리스도의 몸을 함께 건설하는데 이바지 하고자 한다.

영문 초록

A voice of layman who wants to participate in the power of governance of the church(De potestate regiminis ecclesiasticis) which used to be exclusively for clerics in the past is increasing now. Because people cry for “equality”, “right”, and “post-authoritarianism” in today. This may cause dissension or unnecessary tension between the layman and the cleric. The current teachings of the canon law on the relationship between clerics and laymen explain that the relationship is a mutual cooperation and a complement to achieve the church’s joint mission in respect and trust. Can. 129 §2 of the current code of canon law states that “Lay members of Christ’s faithful can cooperate in the exercise of this same power according to the norm of law.” In this study, I looked at the legal scope and limitations of what is possible for the layman’s participation about the church’s power of governance. For this study, at first, I researched legal positions of clerics and laymen in the hierarchy of church. Based on this, it is necessary to recognize the differences between two sides regarding their participation in the power of governance of the church. So the focus was on reducing wasteful arguments and unnecessary conflicts, and building the Christ s body together in each position. In this study, I started with ‘common priesthood’ and ‘ministerial priesthood’ to compare and analyze the concept of ‘ordinary power of governance’,‘delegated power’ and ‘the power of governance of the church’ shown in the old and present code of canon law. As a result, the layman’s participation in the power of governance of the church was confirmed not by its own authority but by certain special mandate given by the law. It also reaffirmed that the power of governance of clerics do not have the irrevocable absolute nature. Clerics and laymen carry out their church mission in different ways, depending on their own condition and office, although there is ‘a genuine equality’ in respect of dignity and action through baptism. This ‘difference’ between clerics and laymen is given by Christ through the sacrament of order. Therefore, the laymen should respect the ‘authority’ of the clerics through recognizing the difference accurately. The clerics also must always be aware that this ‘difference’ is not the concept of ‘discrimination’ to separate ‘a genuine equality’ between clerics and laymen. The cleric’s “rights” from “difference” of “common priesthood” and “ministerial priesthood” are based on “service”. Clerics must pay special attention to this fact and be especially wary of falling into the wrong ‘authoritarianism’. As the current code of canon law teachings, participation of layman in the power of governance of church should be encouraged and allowed more by the cleric so that a role of layman should be activated more within the church.
