독일의 테러대책에 대한 검토

국문 초록

2001년 9월 11일 미국에서 발생한 동시 다발 테러 사건의 영향은 미국뿐만 아니라 독일에서도 적지 않은 문제로 인식되었다. 독일에서 테러에 대한 대책의 문제는 이미 1970년대 이후부터 논의되었고 그에 따라 여러 가지 대책·입법이 강구되어 왔지만, 9·11 사건은 기존의 대책·입법으로는 불충분한 것이 아니냐는 논의가 제기되었고, 이에 연방의회는 새로운 입법 조치를 강구하게 되었다. 그러나 그러한 입법 조치는 독일 기본법과의 관계에서 여러가지 문제를 낳게 되었다. 왜냐하면 인간 본연의 자유에 대한 열망과 사회 속에서의 안전이라는 문제가 이미 독일에서도 논쟁의 중심에 위치하게 되었기 때문이다. 이에 따라 독일의 테러방지 입법 조치는 9·11 사건 이후 크게 5가지 영역에서 실행되었다. 2001년 Vereinsgesetz 개정, 2001년 형법 제129b조 개정, 2002년 Gesetz zur Bekämpfung des internationalen Terrorismus 제정, 2005년 Luftsicherheitsgesetz 제정, 2008년 Gesetz zur Abwehr von Gefahren des internationalen Terrorismus durch das Bundeskriminalamt 개정이다. 그러나 이와 같은 테러방지 입법의 제·개정의 과정에서 또 다른 문제점이 야기되고 있다. 즉, 군대의 활동영역의 확대 정책 문제와 인권 제약의 문제가 비판의 대상이 되는 것이다. 결국 독일의 테러 대책·입법에 있어서 국가의 기본권 보장과 기본권 제한이라는 국민의 기본권에 대한 국가의 개입 강화 문제를 얼마나 조화롭게 실행해 나갈 것인지가 여전히 풀어야 할 과제로 남아 있다는 것이다.

영문 초록

The impact of the simultaneous terrorist attacks in the United States on September 11, 2001 was recognized as a problem not only in the United States but also in Germany. The issue of countermeasures against terrorism in Germany has already been discussed since the 1970s, and various measures and legislation have been put forward. However, the September 11 incident was argued that the existing measures and legislation were insufficient, New legislative measures were taken. However, legislative measures have brought many problems in relation to the German Basic Law because of the problem of human desire for liberty and security in society has already become the center of controversy in Germany. As a result, Germany s anti-terror legislation has been implemented in five major areas since the September 11 incident as follows: Vereinsgesetz amendment in 2001, Amendment of the criminal law 129b in 2001, Establishment of Gesetz zur Bekämpfung des internationalen Terrorismus in 2002, Enactment of Luftsicherheitsgesetz in 2005, Gesetz zur Abwehr von Gefahren des internationalen Terrorismus durch das Bundeskriminalamt amendments. However, there are other problems in the process of enacting and revising the anti-terrorism legislation. It is The issue of enlargement policy of the military s active area and The issue of human rights constraint is the subject of criticism. In the end, it remains to be solved how harmoniously the issue of strengthening the state s intervention in the basic rights of the people, namely the guarantee of the basic rights of the state and the limitation of the basic rights, in the countermeasures and legislation of Germany.
