국문 초록

우리는 국가 정보활동에 있어서 복합적이고 정교한 분석과 철저한 대응전략이 그 어느 때보다도 절실한 시기에 놓여 있다. 특히 국가 정보기관들의 조직체계와 직무내용에 대한 면밀한 진단이 필요하며 상호 효율적인 정보활동을 위해 여러 정보기관들의 정보 및 능력 공유 방안의 필요성이 요구되고 있다. 또한 정보기관들의 기능 발전과 함께 빠르게 진화되어 온 정보의 수집, 분석, 대응 및 공작 능력 및 효율의 변이는 정보조직 운영체계 변화에 결정적인 요인이 되어 왔다. 주요 논의는 국가안보 분야 중에 방첩 및 대테러 활동을 전담하여 수행할 정보기관 조직의 형태는 어떠한 정보기구가 적합한지, 그리고 그 조직 개혁의 근거에 대하여, 나아가 조직체계 변화에 따라 뒷받침되어야할 법적조치를 점검하였다. 이를 위하여 미국의 경우 9.11테러 사태에서 지적된 국내정보전담기관과 국외정보전담기관 사이에 발생하는 방첩 및 대테러활동의 구조적 문제를 해결한 국가정보국(ODNI)의 ‘임무중심’으로의 전환과 ‘조직문화’의 변화 두 가지 핵심 내용을 분석하였다. 이 두 가지 핵심은 과거 한국의 대공방첩 활동사례에서 문제시된 이슈일 뿐만 아니라 현재 국회에 상정된 국정원법 개정안에서도 반드시 고려되어야 할 요소로 그 중요성을 강조하고자 하였다. 또한 개정안 결정권자인 정부 및 국회의 대공방첩 및 대테러활동에 대한 인식을 고취하기 위하여, 정보환경과 안보환경의 변화에 따른 방첩직무자의 전문성 요구와 그에 따른 바람직한 ‘방첩업무규정’의 확립과 특히 최근 제정된 ‘해외인사접촉관리예규’에 대한 문제점 및 수정방안을 기존의 국정원법에 준하여 논의하고자 하였다.

영문 초록

We have more complex and sophisticated analysis and thorough response strategies than ever before in national intelligence activities. In particular, it is necessary to closely examine the organizational structure and job content of national intelligence agencies, and the necessity of sharing information and capabilities among various intelligence organizations is required for efficient intelligence activities. In addition, information gathering, analysis, response, and mutual capability and efficiency variation that have evolved rapidly with the development of the functions of intelligence organizations have been decisive factors in the change of the intelligence operating management system. The main argument is that in the field of national security, the type of intelligence organization that will be dedicated to counter-intelligence and counter-terrorism activities depends on which intelligence organizations are appropriate and where the reforms of the organization should evolve. And examined how legal action should be supported. In the case of the United States, the transition to the mission-centered and organizational culture of the Office of the Director National Intelligence (ODNI), which solved the structural problems between domestic intelligence agencies and foreign intelligence agencies pointed out after the September 11 terrorist attacks. Reviewed the contents of the Korea National Intelligence Service law amendment proposals proposed by the National Assembly to raise the issue through the past counter-intelligence ad terrorism activities in Korea and establish the role of the counter-intelligence and counter-terrorism agency. Based on this, it is necessary to establish the concept of counter-intelligence and counter-terrorism for the government and the parliament to establish the esirable National Intelligence Agency law and regulation, respectively.
