국문 초록

이 연구의 목적은 테러와의 전쟁에 대한 각국의 입법례를 비판적으로 검토하는 것을 목적으로 한다. 독일, 일본 그리고 우리나라의 테러방지법에 나타난 가벌적 예비규정을 비판적으로 검토하는 것이다. 검토결과 형사실체법은 전치화되고 있고, 추상적 위험을 보호법익으로 하는 규정이 다수발견되고 있음을 알 수 있다. 이는 형사실체법의 정당성의 한계를 넘는 것이다. 현대사회를 안전사회로 파악하는 입장은 이러한 상황을 긍정할 것이나, 현재사회 내지 후기현대사회로 파악하는 입장에서는 이러한 상황을 긍정할 수 없다. 실체형법상 정당화가 가능하려면 적어도 구체적 위험범으로 규정되어야만 할 것이다. 이는 네트워크화되어가는 현대사회의 입장에서는 행위자를 특정하기 곤란하기 때문에, 실체형법의 전치화가 한계지워질 수 없기 때문이기도 하다. 이러한 과정에서 일본의 공모죄신설에 대한 논란은 우리에게 시사점을 준다. 이를 바탕으로 하여 테러방지법상의 문제되고 있는 조문에 대해서 비판적으로 해석해보고자 한다.

영문 초록

The purpose of this study is to review the legislation of the nation s laws against terrorism. It is critical to critically review the punitive preliminary provisions in the anti-USA law of Germany, the United States, Japan and Korea. The review indicates that the penal code is being commandeered and that there is a number of rules that are found to be protected by the protection of abstract risks. This is beyond the confines of the criminal justice law. The position of the modern society in which a modern society can be viewed is positively optimistic, but it can not positively identify this situation as we understand it as a modern society or later. It should be stipulated that it is at least a specific offence to be justified in order to be justified by the substantive criminal law. This is because it is difficult to set aside the limits of the underlying criminal justice system, since it is difficult to specify actors in the context of modern society. In this process, the controversy over Japan s creation of a conspiracy gives us a hint. Based on this, I would like to express my sincere interpretation of the mourning clauses of the anti-terror law.
