국가사이버위기관리의 실태와 개선방안에 관한 연구

국문 초록

2017년은 사이버사기를 포함한 다양한 사이버범죄가 발생했다. 특히 자율주행 자동차와 스마트키를 비롯한 최첨단 기기들이 해킹당하는 영상이 외국을 통해 공개되었다. 최첨단 사이버기술이 등장하면 이에 따른 사이버예방기술이 나타났다. 이는 그만큼 사이버범죄수단이 빠르게 등장한다는 것을 보여준다. 사이버사기도 다양하게 발생했다. 특히 가상화폐를 이용한 사기사건은 국민들을 충격에 빠뜨렸다. 가상화폐에 대한 법제도적 준비가 미흡한 상황에서 거래소가 증가하면서 문제는 증폭되었다. 관계부처가 모여 머리를 맞대고 대응책을 준비하고 있지만 가상화폐의 특수한 성질로 인해 접근법이 쉽지 않다. 새롭게 등장하는 사이버사기와 가상화폐의 문제는 우리의 사이버위기관리가 어떻게 잘못되고 미흡한지 잘 보여준다고 생각된다. 지금과 같이 분산된 형태로는 종합적인 대응책을 마련하기 쉽지 않다. 금융위원회에 버금가는 가칭 ‘사이버관리위원회’를 만들어야한다. 사이버관리위원회는 국가기관과 민간을 가리지 않고 예방, 대응, 복구의 3단계 체계와 사이버행정과 정책 및 법률 등을 종합적으로 관리하는 조직이어야 한다. 사이버관리위원회에 사이버수사와 관련된 수사지휘권을 주는 급진적 방안도 고려해볼 수 있다. 우리는 앞으로 어떠한 사이버세상과 마주할지알지 못한다. 앞으로 펼쳐질 사이버세상이 우리의 예측대로 진행될지 아니면 완전히 새로운 분야로 전개될지 모른다. 미래기술의 예측이 불가능한 것이 사이버공간의 매력이라고 할 수 도 있다. 그러나 가상화폐에서 보듯이 급속히 변화되는 사이버환경에 대응하기 위해 기존안보개념의 사이버위기를 확장해야한다. 이를 관리하는 기구도 현재 법률안보다 강화되는 방향으로 논의가 필요하다.

영문 초록

In 2017, a variety of cyber crimes occurred, including cyber fraud. In particular, images of hacking of high-tech devices including autonomous vehicles and smart keys have been released in foreign countries. When cutting-edge cyber technology emerged, the cybercrime method emerged. This shows that cyber criminal means are emerging at a rapid pace. Cyber f r aud also occurred in a variety of ways. In particular, the fraud case using virtual money has shocked the public. Problems were amplified as the number of exchanges increased with the lack of legal institutional arrangements for virtual money. Relevant ministries are gathering heads together and preparing countermeasures, but the approach is not easy due to the special nature of virtual money. The new issue of cyber fraud and virtual money seems to show how our cyber crisis management is wrong and inadequate. It is not easy to create comprehensive countermeasures in this distributed form. The Cyber Management Committee, which is equivalent to the Financial Services Commission, should be created. The Cyber M anagement Committee should be an organization that manages cyber administration, policies and laws in a comprehensive manner, with a three-step system of prevention, response, and restoration, regardless of national institutions or the private sector. It is also possible to consider radical measures to give the Cyber M anagement Committee the authority to conduct investigations related to cybercrime. We do not know what cyber world will face in the future. The cyber world that will be unfolded in the future may proceed according to our predictions or develop into a whole new field. The unpredictability of future technologies may be the attraction of cyberspace. However, in order to cope with rapidly changing cyber environment as seen in virtual money, cyber crisis of existing security concept should be expanded. The organization that manages this is also needed to be discussed in a direction that is stronger than the current law.
