통일헌법의 기본원리로서의 민주주의 연구

국문 초록

남북 간의 통일이 반드시 필요한가에 대해서는 부정적인 여론의 비율이 높아 지는 것이 오늘날의 추세이며, 분단 이후 여러 세대를 거쳐 70년이 흐른 현 시점 에서는 이산가족 문제와 같은 인도적 차원의 문제나 같은 민족이므로 통일이 되어야 한다는 민족주의 논변도 과거와 같이 큰 설득력을 가지기 어렵게 되었다. 그러나 아직도 많은 국민이 궁극적으로는 통일을 바라고 있는 것이 현실임을 부인할 수는 없고, 무엇보다 대한민국 헌법은 통일을 가장 중요한 국가목표로 설정 하고 있으므로 이를 외면할 수도 없다. 그렇다면 우리가 추구하는 통일의 규범적 토대로서의 통일헌법의 기본원리는 무엇이어야 하는가에 대해서 현 시점에서 다시금 되물어볼 필요가 있다. 이제는 민족의 동질성 회복차원에서, 그리고 통일의 동력을 구하는 의미에서 민족주의와 더불어, 통일국가의 조직과 사회통합을 위한 보편적인 헌법원리로서의 민주주의가 매우 중요하게 취급되어야 한다. 그러나 통일의 과정에서 핵심적인 역할을 담당할 수밖에 없는 대한민국의 민주주의 원리, 특히 자유민주적 기본질서가 원리 로서나 현실의 적용에 있어서 완전한 민주주의에 도달했다고 볼 수 있는가는 아직까지는 회의적이다. 특히 대한민국 민주주의의 핵심개념인 자유민주적 기본질 서는 과거에 반공주의나 시장주의로 오‧남용되었던 부정적 역사가 있기 때문에 이제 자유민주적 기본질서는 대한민국 헌법의 제고를 위해서도, 또 통일헌법을 위해서도 재해석되고 재구성되어야 한다. 그것은 소극적 자유나 시장에만 절대적 우위를 두는 닫힌 민주주의가 아니라, 적극적 자유와 사회민주주의에도 개방된 열린 민주주의여야 한다. 이를 위해서는 필자는 자유민주적 기본질서, 특히 민주 주의의 구체화된 개념으로 참여, 숙의, 공화를 제시하고자 하며, 이들 개념들이 균형 있게 공존하는 정치체제를 구축할 때 우리는 물론 북한도 포용할 수 있는 한반도 통일국가의 형성이 앞당겨질 수 있을 것이다. 그러나 민주주의는 단순히 원리나 이론에만 그치는 것이 아니다. 민주주의는 실천이고 경험이며 현실이다. 따라서 우리 스스로가 민주시민으로서의 자질을 함양할 수 있도록 통일교육, 민주시민교육, 헌법교육을 더욱 활성화시킬 필요가 있으며, 자유민주적 기본질서에 대한 경험이 없는 북한주민들이 새롭게 민주주의 원리에 적응할 수 있도록 하기 위해서는, 북한이탈주민에 대한 민주주의 교육을 시작으로 하여 통일 이후까지를 차근차근 준비해나가야 할 것이다.

영문 초록

The public opinion these days is increasingly leaning against the re-unification of the Koreas. The humanitarian argument - that families separated by the Korean War need to be reunited - is losing its persuasiveness. The nationalistic argument - that Korea as a nation has to be united in one country - is also failing to garner support. However, ultimately, many Koreans still yearn to see their nation re-united, while the Constitution lists reunification as the most important national objective. At this point, the question arises on what should constitute the basic principle of post-reunification Constitution, as the normative foundation of the reunification we pursue as a nation. Democracy, as a universally accepted principle of Constitution for the organization of a re-united country and social integration, should be dealt with in the most significant manner, along with nationalism propelled by the desire to restore national homogeneity. Nonetheless, it is yet premature to conclude that Korean democracy, which will inevitably play a central role in the re-unification process, has been consummated as a free democratic political order or in actual practice. Especially, because free democratic order in the past was wrongfully used to support the anti-communist and free market rhetorics, liberal democracy needs to be re-interpreted and re-made, for the improvement of the existing Constitution and the post-reunification Constitution. This does not refer to a closed democracy which only places an absolute advantage on passive liberties or market, but also those on active liberties and openness to social democracy. I propose liberal democracy and specific concepts under democracy such as participation, deliberation and republicanism, and posits that the formation of a re-unified state on the Korean peninsula can only be expedited with the establishment of a political system in which those concepts have balanced presence. Nonetheless, it must be noted that democracy is not a mere principle or theory. It is a practice, experience and reality. Therefore, education on re-unification, civil life, and the Constitution needs to be expanded, in order to improve our quality as democratic citizens. Moreover, in order to accommodate North Koreans, who are inexperienced in democracy, education on the life in a democracy needs to begin with those who have defected and continue into post-reunification.
