미국의 디지털 기본권 논의에 대한 소고

국문 초록

현대 사회의 급속한 변화로 인해 1987년 제정된 현행 헌법의 개정에 관한 논의가 실무적ㆍ이론적으로 끊이지 않는 현실 속에서 헌법적 보호가 필요한 새로운 기본권에 관한 검토는 이론적 관심을 넘어 실무적인 가치를 가지는 작업이라할 수 있을 것이다. 이에 본 논문은 현대 사회의 가장 커다란 특징 가운데 하나라 할 수 있는 정보통신기술(Information communication technology; ICT)이 탄생 시킨 디지털 환경과 직ㆍ간접적으로 관련을 가지는 권리들 가운데 헌법적 가치가 인정될만한 기본적 권리라는 디지털 기본권에 대한 시론적인 개념설정을 바탕으로 미국에서의 디지털 기본권과 관련한 실무ㆍ이론적 논의들을 개략적으로 살펴보았다. 미국은 ICT에 있어서 세계에서 가장 선진적인 국가 중의 하나임에도 기대와는 달리 디지털 기본권에 관한 논의, 특히 실무적 논의는 유럽에 비해 그다지 적극 적인 모습을 보이지 않고 있음이 확인된다. 이는 표현의 자유를 다른 기본권보다도 우선적인 권리로 취급해 온 미국 헌법사의 맥락에서 프라이버시의 보호와 표현의 자유간의 상충에 대한 우려가 반영된 것으로 볼 수 있으며, 아울러 상대적 으로 개인정보의 보호보다 활용에 치중하는 미국의 입장 역시 오늘날의 미국사 회가 전반적으로 정보와 관련한 경제와 사회의 성장과 다양화로 대표되는 특성이 실제적으로 작용된 결과라 할 수 있을 것이다. 결론적으로 특히 미국의 인터넷 발전 초기, 당시의 국가정보기반시설의 발전의 주요한 열쇠로 꼽힌 공공 정보에의 접근 가능성 및 전통적인 정보의 자유의 온라인 환경으로의 확장이론을 감안하면, 새로운 디지털 기본권의 신설에 관한 논의들의 중요성에 못지않게 정보 시장에서의 자유의 증진과 기존 기본권 체계의 디지털 환경으로의 확장에 대한 고민 역시 필요하다고 할 것이다.

영문 초록

Considering the ongoing practical and theoretical debates on the revision of the current constitution of Korea which was enacted in 1987, a study on new fundamental rights that require constitutional protection would have practical value beyond the theoretical interests. In this context, the study provides an operational definition of ‘digital fundamental rights’ as some rights with constitutional value among the rights related directly or indirectly to the ‘digital environment’ created by information-communication technology(ICT) which is one of the greatest features of modern society and examines legal practices and theoretical arguments in United States related to the digital fundamental rights. Contrary to many people’s expectations, although the United States which is one of the most ICT-advanced countries in the world, the arguments in the United State on digital fundamental rights, especially in practical fields, are not as active as in Europe. This could reflect the concerns of the conflict between the protection of privacy and freedom of expression in the context of the Constitution of the United States, which treats freedom of expression as a priority over other fundamental rights. In addition, the United States’ position on the utilization rather than the protection of personal information could be also a result of the fact that today’s American society is generally characterized the economic and social growth and diversification related to ICT.The study conclusively confirms that it is necessary to raise the freedom of the information market and to expand the existing system of the fundamental rights to the digital environment, considering the argument in the early years of the Internet development in the United States, that considering the accession to public information and the expansion of the traditional freedom of information to the online environment as the key to the development of the nation s information infrastructure.
