일본에서의 디지털 기본권에 관한 연구

국문 초록

일본에서는 헌법개정론으로 프라이버시권과 알권리의 내용을 명확히 한 초안이 등장한 바 있다. 그러나 전문가들 사이에서는 헌법개헌을 통하여 디지털 기본 권이나 정보기본권의 신설논의의 제기하기 보다는 일본국 헌법 제13조 인간존중 과, 생명ㆍ자유 및 행복추구에 관한 국민의 권리에서 새롭고 다양한 디지털 기본권 혹은 정보기본권을 도출할 수 있다는 취지로 논의된다. 2011년 일본 자민당의 헌법개정초안에서도 자민당 헌법개정안을 보면 제19조 (사상과 양심의 자유)에 추가하여, 정보에 관하여 “제19조의2(개인정보의 부당취득 금지 등) 규정을 신설하고 있다. 2015년 발표된 마츠시타 정경숙에서 제안한 헌법개정초안에서도 “새로운 인권”에 대하여, “일본국헌법 제13조는 인격적 생존에 필요불가결한 권리ㆍ자유를 포섭하는 포괄적 권리로서의 성격을 갖고 있기 때문에, 헌법에 명기되지 않은 인권의 창설을 예정하고 있다는 권리성 긍정설이 통설ㆍ판례 입장이고, 이후 확립된 새로운 인권을 순차적으로 헌법에 집어넣어야 한다는 생각이다. 새로운 인권을 헌법에 집어넣을 경우, 구체적인 내용으로 환경 권, 프라이버시권, 알권리에 대한 조문화를 검토했다. 일본에서 최근 논의되는 다양한 디지털에 관한 새로운 권리론이나 의무론으로, 국가의 시큐리티에 대한 주의의무, 망 중립성 의무, 프라이버시ㆍ개인정보자기통 제권, 데이터 이동권(right to Data Portability), 잊혀질 권리, 데이터보호를 위한 저작권법 및 부정경쟁밥지법에 의한 논의가 진행되고 있다. AI 알고리즘에 대한 설명요구권, 통신이력삭제권 등이 논이 되고 있다. 이중 ‘사이버 시큐리티 기본법’과 같이 기본법이라는 형태로 입법되는 경우도 있다. 잊혀질 권리(right to be forgotten)는 이미 헌법상 인격권에 근거하여 일본 재판소에서 인터넷 검색에서의 삭제권이 인정되는 판례가 계속 등장하고 있다. 앞으로는 AI와 자동의사결정에 대한 설명요구권과 같은 논의가 일본의 특유한 논의보다는 국제적인 흐름에 발맞춘 논의가 계속되고, 이것은 권리론, 법제도론으로 구체화 될 것이다.

영문 초록

In Japan, drafts of the right to privacy and the right to know have emerged through the constitutional amendment bill. However, experts in the Constitutional Law and Information Law would like to translate the Article 13 of the Constitution of Japan, human dignity and the right to pursue happiness, draw liberty and digital fundamental rights, rather than raising the issue of new fundamental rights through amendments to the Constitutional Law. In the draft amendment to the Constitution of Liberal Democratic Party of Japan in 2011, in addition to Article 19(freedom of thought and conscience), Article 19-2(prohibition of unfair acquisition personal information) Personal information should not be used or acquired unfairly. And In the 2015 draft amendment proposed by the Matsushita institute of Government and Management, the Human right derived through from Article 13 of the Japanese Constitutional law is comprehensive right, which entails indispensable rights and right to live. And it is a common idea that the digital fundamental rights, which is supposed to create human rights, are not yet established. New human rights should be put into the Constitutional law sequentially. When a new human right is put into the Constitution, it is important to consider the scope of the right, such as right of self-determination, right of portrait, right of honor, environmental right, right of sight and so on. In Japan, there is a new digital rights theory as new rights, obligations, and legal systems. It is the obligation of national security, network neutrality, privacy, right of self-information control, right to data portability, right to be forgotten, copyright law for data protection, and ‘Unfair Competition Prevention Act’. Right to explanation on AI algorithm and right to delete on cyberspace are being discussed. In some cases, such as the ‘The Basic Act on Cybersecurity’, it is also legislated in the form of basic law. Right to be forgotten has already been recognized by the court on the basis of the moral right of the Constitution, and judicial precedents continue to be granted. In the future, discussions such as AI and right to explain on automatic decision-making will be discussed internationally rather than peculiar discussions in Japan.
