보험업의 해외진출과 법적 개선방안

국문 초록

국내 보험시장은 더 이상 지속적인 성장을 기대할 수 없는 포화국면을 맞이하고 있기에 국내 보험사의 해외진출은 이제는 선택사항이 아닌 생존을 위한 필수적인 조건이 되었다. 그러나 아직까지는 국내 보험사들의 열악한 재무구조와 낮은 인지도, 상이한 현지 문화와 규범 체계, 국내 법규상의 제한 등 여러 가지 난관으로 인하여 국내 보험사들의 해외 보험시장 진출이 성공적으로 이루어지지 못하고 있다. 따라서 보험회사가 성공적으로 해외에 진출하고, 안정적인 수익을 창출할 수 있는 새로운 해외진출 모델을 검토할 필요가 있다. 본 논문에서는 보험계약의 모집ㆍ인수ㆍ체결 및 보험금 지급 등의 제반 보험업무를 현지에서 활동하는 글로벌 보험전문 대행인에게 위탁하는 방안을 검토하였다. 필자는 해외에 진출한 국내보험회사가 보험계약의 인수나 유지 등 본질적인 업무에 대해서 전문적인 제3자에게 업무위탁을 할 수 있도록 현행 금융기관업무위탁규정을 시급히 개정할 것을 개선안으로 제안하였다.

영문 초록

Domestic insurance market is in a saturation phase, in which no further growth is expected. As a result, domestic insurers’ overseas expansion is no longer an option but a necessary condition for survival. However, it is a fact that can not be denied that domestic insurers have not been successful in entering the overseas insurance market due to various difficulties such as poor financial structure of Korean insurers, low recognition, different local culture and norm system. Therefore it is necessary to review new overseas entry models to help insurance companies successfully enter overseas and create a stable profit. In this thesis, I will review the way of entrusting the insurance business such as recruitment, acquisition and conclusion of insurance contracts and insurance payments to global insurance professional agent acting locally. I proposed that the regulations should be urgently revised so that domestic insurance company can entrust professional third parties with essential business such as acquisition or maintenance of insurance contracts.
