국문 초록

이 글은 58년 대륙붕 협약의 가입 관련 논쟁과 기후변화협약 협상 및 수용과정을 중심으로 한국의 다자조약 가입·수용과정에서 작동하는 관료조직 간의 갈등·경쟁·협상 과정을 분석한다. 시기적 차이, 권위주의 대(對) 다원화된 의사결정 시스템이라는 상이한 조건하에 일어난 두 사례에서 공통적으로 관료정치 현상이 확인된다면, 관료정 치의 높은 빈도와 상당한 영향력을 합리적으로 추정해 볼 수 있는바, 이에 비교의 이론적 의의가 있다. 해제 외교사료에 대한 해석적 사례연구 분석 및 전문가 인터뷰 등을 토대로 한 두 사례의 분석 결과에서 공통적으로 관료정치 현상이 확인된다. 58년 대륙붕 협약 가입관련 과학기술처는 해양자원 확보를 이유로 조속한 가입을 추진한 반면, 외무부는 평화선 등 우리정부의 국제법상 입장과 동 조약의 불확실성에 입각하여 신중론을 전개하 였고 두 부처는 경쟁적으로 상이한 견해를 청와대에 상신하였다. 기후변화협약의 협상 및 수용과정에서도 산업계의 타격을 우려한 산자부, 온실가스 절대량 감축의 달성을 중시한 환경부, 국제적 평판비용(reputation cost) 및 상위 외교전략과의 정합성을 중시한 외교부 간 갈등과 경쟁은 주요 기후변화 조약의 각 발전단계에서 반복되는 양상을 보이고 있다.

영문 초록

This paper illuminates the features of bureaucratic politics in Korea’s accession and adoption of multilateral treaties. In particular, the paper focuses on two cases: the controversy over the Geneva Convention on the Continental Shelf in 1958 and monumental treaties on the climate change. The case-selection can analytically be justified since the frequency and influence of the bureaucratic process can be rationally assumed in other cases when such trend is confirmed in two temporarily dispersed cases under the idiosyncratic political conditions. The analysis on de-classified diplomatic documents and other materials vividly demonstrates the salience of bureaucratic politics in two cases. To begin with, Ministry of Science and Technology pursued the rapid accession and ratification of the Geneva Convention on the Continental Shelf whereas the Ministry of Foreign Affairs opposed to it. Consistent with the bureaucratic model, the organizational turf and interests substantially influenced two organs’ contrasting stances. Similarly, Ministry of Trade, Industry and Energy(MOTIE), Ministry of Environment(MOE), and the Ministry of Foreign Affairs competed and negotiated each other in the negotiation and domestic adoption of three monumental treaties of climate change.
