블록체인 활용방안에 대한 규범적 고찰

국문 초록

비트코인에 대한 관심이 뜨겁다. 최초의 암호화폐인 비트코인의 가격은 하늘높은 줄 모르고 치솟다가 등락을 반복하고 있으며, 세계 각국의 정부는 그 법적지위를 어떻게 설정할지 고민하고 있다. 하지만 이러한 현상은 앞으로 다가올 변화를 두고 볼 때 빙산의 일각에 불과하다. 비트코인이 아니라 그 기반기술인 “블록체인”이 가져올 변화의 가능성과 폭은 무궁하기 때문이다. 블록체인 기술이 활용될 경우 법제도에 어떠한 방식으로 접목될 수 있는지에 대한 연구가 필요하다. 블록체인 기술은 특히 시각저작물 분야에 유용하게 활용되고 있다. 시각저작물은 디지털로 변형하기 쉬워 블록체인 기술을 용이하게 적용할 수 있기 때문이다. 이러한 특징과 더불어 기술이 지닌 속성들은 상대적으로 시장이 덜 성숙되어 있는 국내의 미술품 유통분야에서 유익하게 활용될 여지가 크다. 기술이 지닌 분권성과 확장성은 “중개자를 거치지 아니한, 다양한 유형의 거래”를 가능하게 하며, 익명성과 보안성은 “추적이 가능하지만 익명인, 위변조가 불가능한 공시수단”을 제공해줄 수 있기 때문이다. 본 논문을 통해 블록체인 기술을 적용할 경우 법제도에 미칠 영향을 국내 미술품 유통시장을 중심으로 고민해 보고자 한다. 우선 ① 블록체인 기술의 등장과 발전에 대해 살펴보겠다. 이를 통해 ② 블록체인 기술이 지닌 규범적인 함의를 정리한다. 다음으로 ③ 이러한 함의가 저작권 보호에 어떻게 기여할 수 있는지를 저작물성, 저작인격권, 저작재산권 측면으로 나누어 분석한다. 비록 블록체인이 저작권 보호에 활용되고 있는 현황이 미술품 유통시장에 대한 논의와 직접 연결되지는 않지만, 기술이 지닌 규범적인 함의를 바탕으로 법제도적 활용방안을 모색하고자 하는 본고의 논지상 검토할 필요가 있다. 이를 바탕으로 ④ 오늘날 논의되고 있는 국내 미술품 유통시장 개선방안에 대해 블록체인을 활용하여 효과를 기대할 수 있는 정책방안을 모색해 본다.

영문 초록

Interest in Bitcoin is hot. The price of the first encrypted coin is skyrocketing, soaring and fluctuating. Governments around the world are wondering how to set the legal status. However, this phenomenon is just the tip of the iceberg in the coming changes. The possibilities and breadth of the changes that the block chain will bring is unending. It is necessary to study how block chain technology can be applied to the legal system. Block chain techniques are particularly useful in the visual arts field. This is because it is easy to transform a visual work into a digital one, so that a block chain technique can be easily applied. In addition to these characteristics, the attributes of the technology are likely to be beneficially utilized in domestic art distribution, where the market is relatively mature. The decentralization and scalability of technology enables various types of transactions that do not go through intermediaries , and anonymity and security can provide traceable but anonymous, unforgeable disclosure methods . In this paper, I would like to consider the impact of the block chain technology on the legal system in the domestic art market. First, I will examine the emergence and development of the block chain technology. Through this, we summarize the normative implications of block chain technology. Next, I will analyze how these implications contribute to copyright protection by dividing them into copyright ability, moral rights, and author’s property right. Although the current situation where the block chain is being used for copyright protection is not directly related to the discussion on the art market, there is a need to review this paper to find new ways of utilizing the legal system based on the normative implications of technology. Based on this, I will look for policy measures that can expect effects by using the block chain to improve the distribution market of domestic art market discussed today.
