국문 초록

불법복제품의 공급은 복제비용과 발각 시 처벌수준을 가늠할 수 있는 저작권보호법의 강도에 의해 영향을 받는다는 가정아래 이 논문에서는 그래프를 통한 직관적 분석으로 복제자의 비용의 과다와 보호법의 강약에 따라 각각 다른 결과를 초래하는 것을 보이고 그 정책적 함의를 도출한다. 복제자의 비용이 큰 경우에 너무 강한 저작권보호법은 오히려 소비자잉여를 줄 이고 사회적 비용을 증대시키는 바람직하지 못한 결과를 초래한다. 반면, 디지털 기술의 발달로 인해 저작물의 복제비가 저렴해져서 복제자의 비용이 적어진 디지털 시대에는 저작권보호의 강도를 높여야 저작자의 창작의욕을 보장해주며 복제자의 부당한 이득을 줄일 수 있게 된다. 그렇지만 이 경우에도 소비자 잉여가 준다는 부작용은 발생하므로 저작자의 이윤 상승과 소비자의 잉여 감소의 상환관계에 대한 사회적 비용-편익 분석이 요구된다.

영문 초록

With the assumption that the supply of copies would be affected by the copier s cost of producing and distributing copies and the strength of copyright protection, we analyze graphically the impact of the strength of the copyright protection on the behavior of the copier intuitively. From the analysis, some implications of the optimal strength of the copyright protection and the infringement of copyrights are discussed. When the costs of producing copies are high, strong copyright protection may adversely affect the welfare of the consumers by reducing the consumers surplus and increasing the social cost. On the other hand, when the costs of producing copies are too low as in the digitized environment of today, strengthening copyright protection may be necessary in order to stimulate the creative class to create and also in order to prevent the unjustified high profit of the copiers. However, consumer s surplus is reduced in this case also. Thus, it may be necessary to have a cost-benefit analysis of the tradeoff between the increase in the profit of the authors and the reduction in consumer s surplus.
