국문 초록

지난 2014년 10월 30일 헌법재판소는 국회의원 지역선거구별 상하 인구편차를 최대 3:1까지 허용하는 현행 공직선거법(제25조 제2항)이 헌법에 명시된 평등선거 원칙에 위배되는 것을 근거로 헌법 불합치 판결을 내렸다. 이는 인구이동이나 급속한 사회변동 등 최근 한국 사회에서 일어난 일련의 인구사회학적 변화에 부응하는 새로운 선거 구의 기준에 대한 사회적 요구에 따른 판결이라 평가할 수 있을 것이다. 기존 선거구 구획의 헌법 불합치성에 대한 헌재의 판결 이후 국회의원 선거구 재획정과 관련된 많은 학술적 논의들이 제기되어 왔다. 본 논문은 국회의원 선거구 획정과 관련해 현재 까지 학계나 정치권에서 제기되었던 여러 쟁점들을 정리해보고, 앞으로의 과제가 무엇인가 살펴보는 것을 목적으로 한다. 특히, 본 논문은 선거구 재획정 문제의 주된 쟁점을 전체 의석수 대비 비례대표 의석 비중 그리고 비례대표 선출 방식 등으로 규정 하고, 한국에서 비례대표제 확대 또는 선거제도의 비례성 제고 방안과 관련해 상정해볼 수 있는 다양한 학술적 논의들의 잠재적 방향에 대한 조명을 해본다.

영문 초록

The current electoral district system for Korean parliamentary elections has allowed three to one ratio between the most populated and the least populated districts. But the Constitutional Court of Korea ruled in October 2014 that the existing system if unconstitutional since it violates the principle of equality in the value of a vote across different districts. Based on the verdict made by the Court, the ratio should be reduced from three to one to two to one or less from January 2015. Since the Court s decision of 2014, scholarly or political debate has grown over the electoral redistricting, especially focusing on the representation gap between cities and rural regions. This study examines and reviews alternatives and issues raised so far regarding the electoral redistricting. In particular, this study argues that a key issue of the politics of redistricting involves the proportion of PR seats and how those PR seats are allocated and alloted. Finally, this study sheds light on the potential issues for scholarly discussion on the reform of PR system in Korea.
