국문 초록

본 연구의 목적은 주위토지통행권에 관한 기본 법리를 토대로 주위토지통행권이 인정된 지역의 일반적인 사례 및 주위토지통행권을 둘러싼 분쟁사례를 조사하여 문제점을 진단하고, 그와 같은 문제를 해결하기 위한 제도적 장치로서 주위토지통행권이 인정된 필지에 대하여 지적공시의 방향을 제시하는 것이다. 이와 같은 목적으로 본 연구는 사례조사 및 판례평석 등을 수행하였고, 그 결과 통해 주위토지통행권의 공시에 대한 제도적 개선방향으로서 첫째, 전국적으로 산재한 맹지의 현황데이터를 추출하고 둘째, 추출된 데이터의 주위토지통행권 인정관계 여부를 확인하며 셋째, 주위토지통행권이 인정된 필지에 대해서는 지적공부를 통해 그 사실관계가 명확히 공시될 수 있는 내용과 절차를 제시하였다.

영문 초록

The purpose of this study is to diagnose the problems by examining the general case of the area where the right of passing the neighboring land is recognized and the case of the dispute over the right of the neighboring land on the basis of the basic law of the right of passing on the neighboring land. In order to solve such a problem, the direction of intellectual disclosure is proposed to the parcels where the right of passing on the neighboring land is recognized as an institutional apparatus. For this purpose, this study conducted case studies and case reviews. As a result, the direction of institutional improvement on the disclosure of the right of passing to the neighboring land was derived. Firstly, d extracted the current status data onto the land that did not contact roads distributed all over the country. Secondly, we confirmed whether the extracted data is related to the recognition of the right to transit land. Lastly, for the parcels where the right of passing on the neighboring land was recognized, the contents and the procedure that the facts can be clearly disclosed through cadastral study were presented.
