테러방지법상 정보공유 시스템의 비판적 검토

국문 초록

‘국민보호와 공공안전을 위한 테러방지법(이하 테러방지법)’이 제정ㆍ시행된지 1년 6개월이라는 짧지 않은 시간임에도 불구하고 그 존폐여부에 대한 논란 등 테러방지법은 안정화 단계에 접어들지 못하고 아직도 논란의 연속선상에 놓여 있다. 이처럼 테러방지법에 대한 다양한 시각이 교차하고 있는 실정에서 본고는 현행 테러방지법의 효율적인 운용에 주안점을 두어 문제점과 개선방안을 찾고자 하였다. 최근의 테러범죄는 그 성격상 사전적 예방이 더욱 중요성을 가진다. 테러범죄를 사전에 예방하는 최선의 방안은 테러범죄에 관련된 정보를 정보ㆍ수사기관이 적시에 공유하여 그 나라의 사법제도에 최적화된 사전적 예방조치를 하는 것이다. 즉 테러범죄의 사전적 예방의 핵심에는 테러관련정보의 공유가 자리잡고 있다. 따라서 우선적으로 프랑스와 벨기에 등 최근 발생한 테러범죄 사례에서 정보의 가치와 정보실패 사례를 분석하고, 그 시사점을 찾도록 하였다. 그 검토결과 우리 테러방지법은 정보기관과 수사기관의 정보공유를 실질적으로 보장하는 규정이 없다는 점을 확인하고, 테러범죄의 사전 예방적 관점에서 그 개선방안을 모색하였다. 이에 따라 정보기관과 수사기관의 정보 “공유” 시스템의 강화 및 제도화를 위한 구체적 입법안을 제시하였다. 즉, 테러정보의 수집은 국내에서 자체적으로 수집되는 정보와 해외기관과 국내 관련기관으로부터 전달받는다는 전제에서 ⅰ) 국내 공개정보의 분석 및 공유방안은 KICS 등을 활용하는 정보분석관의 배치ㆍ육성을, ⅱ) 관련기관으로부터의 정보수집 및 공유방안 제도화는 국무조정실 산하 대테러센터의 업무에 수사기관에 대한 테러정보의 하달을 제도적으로 입법안을 제시하였다.

영문 초록

Despite “ACT ON ANTI-TERRORISM FOR THE PROTECTION OF CITIZENS AND PUBLIC SECURITY(Act on Anti-Terrorism)” was enacted and implemented in a short period of one year and six months, Act on Anti-Terrorism including the controversy over its existence. In the wake of the differing views on the Act on Anti-Terrorism, the study sought to find ways to prevent problems and improve the effectiveness of the current Act on Anti-Terrorism. Recent terror crimes have more important precautions in nature. The best way to prevent terror crimes is to provide timely preventive measures for terror crimes by sharing information related to terror crimes in the timely manner. At the heart of the terror crimes, there is a sharing of terror related information. Therefore, it was analyzed that the value of the intelligence and intelligence failed in the recent cases of terror crimes such as Terror at France and Belgium was analyzed and the implications were sought. The review found that the Act on Anti-Terrorism has no provisions to effectively guarantee intelligence sharing between intelligence agencies and law enforcement agencies, and sought improvements in the prevention of terror crime. In order to do this, I assume that the collection of terror intelligence is received from the domestic self-collected intelligence, the foreign agencies, and the related organizations in Korea. 1) The analysis and sharing method of the public intelligence in Korea is based on the arrangement and fostering of information analysts using KICS, 2) Institutionalization of collecting and sharing intelligence from related organizations suggested the provision of systematic guarantee of terror intelligence to the law-enforcement agency in the work of the counter-terrorism center under the Office of the State Coordination Office. However, the emphasis on intelligence in counter terror crime has pointed out the problem that it is difficult to compel the comparison of freedom and security in the counter-terrorism crime by submitting terrorism act as an area of security instead of crime. Therefore, while recognizing the importance of intelligence in response to the terror “crime”, I pointed out that we should be alert to the infringement of human rights by the intelligence gathering and sharing of intelligence and law-enforcement agencies.
