과학기술 발전에 따른 현대형 수사방법의 필요성과 적법성

국문 초록

고도 정보통신사회로 사회가 진화하고 범죄수법이 진화해가는 변화에 상응하여 수사방법 역시 변화될 필요성이 있고 법규범의 해석도 변천해가야 한다는 논의가 필요하게 되었다. 새로운 수사기법에 대해 그에 상응한 법정비가 이루어져야 하는 만큼 그 문제는 입법론으로 귀결되므로 발전된 과학기술이 반영된 수사기법의 적법성 판단에 대해 현행법상 영장주의의 적용에 대해서도 새로운 해석이 필요하다. 미국과 일본의 경우 GPS 추적 장치를 부착한 수사 실무를 둘러싼 판례가 축적되어왔다. GPS 추적 장치를 용의자의 차량에 부착한 수사에 대해 미국의 경우 2012년 미연방대법원에서 “정보를 수집하기 위해 피고인의 차량에 GPS 추적 장치를 부착하는 것은 피고인의 재산을 침범한 것이므로, 수색에 해당 한다”는 입장을 밝혔다. 일본의 경우 하급심 판례에서 상반된 판결을 거듭해오다 올해 3월 최고재판소에서 “법원의 영장 없이 범죄 용의자 차량에 GPS 추적 장치를 부착하는 수사 기법은 위법”이라는 입장을 밝히며 수사기관 및 관련 업계에 큰 영향을 미치고 있다. 이에 비해 국내의 경우 지금까지 일반적으로 휴대전화 위치추적을 통한 범죄수사가 이루어져 왔으나 2015년 후반부터 GPS단말기를 이용한 수사기법의 활용 및 이를 위한 영장제도의 도입 논의가 이루어지기 시작했으며 검찰도 현행법상으로는 도주 중인 범죄자추적에 한계가 있는 바 GPS정보를 사용할 수 있는 방안을 모색해야 함을 피력했다. 미국 및 일본과 같이 GPS 추적 장치를 이용한 수사의 적법성에 관하여 우리 판례에서 심도 있게 다루어진 적은 없지만 선행실시국의 이용 실례와 관련 판례의 변화를 분석하여 시사를 이끌어냄으로써 앞으로 GPS 추적 장치를 활용한 수사기법을 운용함에 있어 선험적이고 실용적인 방향성을 제시할 것으로 기대되며 GPS단말기 부착수사라는 새로운 수사기법에 따른 형사소송법상의 흥미 있는 문제를 포함하는 만큼 특히 최근 의미 있는 판결을 낸 일본의 최고재판소 판례를 분석하고 그로부터 시사를 이끌어내었다.

영문 초록

The evolution of information service providers and the evolution of the criminal codes in response to the evolution of criminal codes has also led to the need for changes in the law and the need to change the interpretation of the law. Appropriate legal maintenance techniques should be provided for the new investigation techniques. This also leads to legislation, which requires a new interpretation of the application of the current law on the legitimacy of investigations into the legitimacy of the investigation techniques reflecting advanced scientific techniques. In the United States and Japan, the court has accumulated a precedent surrounding the investigation of the investigation of the GPS tracking system. In response to the investigation of the GPS tracking device to the suspect’s vehicle, the U.S. Supreme Court said in the United States that attaching GPS tracking devices to the accused in order to collect information from the defendant in 2012 would constitute a search. In the case of Japan, which has been inconsistent with the Supreme Court in March, the investigation of the investigation of the GPS tracking system in the March issue of the Supreme Court without a warrant of a court probe is illegal, and it has a significant influence on investigative agencies and related industries. Consequentially, a criminal investigation has been conducted in the past, but it has begun to introduce a probe into the use of probes and the introduction of a warrant to investigate the use of probes using GPS terminals since 2015. The prosecution also argued that it should seek ways to use GPS information because the current law on criminal offenders is limited. Although we have never dealt with the legitimacy of the investigation using the GPS tracking system, such as the U.S. and Japan, we are expected to present a priori and practical orientation in the future of using the GPS tracking system by analyzing the use cases of the preceding precedent and initiating the precedent of using the relevant precedent. Based on the novel, which is the subject of a criminal investigation by the Criminal Procedure Act, it is particularly important to review the contents of Japan s Supreme Court, which has recently found a meaningful verdict on the criminal justice system.
