기관구성의 측면에서 경기연정(연합정치)이 갖는 법적 문제에 관한 소고

국문 초록

현재 경기도에서 새로운 형태의 정치실험이 행해지고 있다. 이른바 경기연정 이라 불리는 지방정치 시스템이다. 계속되어 오던 진영간 다툼을 종식시키고 대화와 타협을 통한 소통의 정치를 향한 시도라고 할 수 있다. 이러한 경기연정에 대 하여 정치학, 행정학 분야에서는 경기연정을 지방자치단체에서의 새로운 정치체제의 시도로 보고 그 성과를 평가하고 지속가능성을 타진하는 연구가 일부 있어 왔으나, 법적 관점에서 경기연정을 평가하고 분석한 연구는 아직 없다. 이 즈음에 서 1차적으로는 경기연정이 갖는 법적 의미에 대하여 살펴보고, 경기연정에 대한 합법성검토 및 타당성검토를 통해 현행법 체계와 조화로운지에 대한 검토한다. 경기연정은 다수결민주주의의 한계를 극복하고 합의민주주의로 나아가는 협의민주 주의라는 중간적 지점에 있다는 평가를 받기도 한다. 엄격한 권력분립형 기관구성이 이루어지는 현행법 체계하에서 정치적 정당적 성향이 다름으로 인하여 야기될수 있는 지방자치단체의 정책수행의 장애요소를 협치라는 관점에서 풀어나가고 있는 것이다. 경기연정의 특징적인 요소인 사회통합부지사(연정부지사)와 인사청문의 문제가 현행법 체계하에서 합법성을 띠는지에 대하여 살펴보았다. 사회통합 부지사의 선출은 집행기관인 단체장과 다수당의 합의로 이루어졌지만, 이를 제도 화하기에는 법적 근거가 미약하다. 또한 인사청문의 문제 역시 견제와 균형의 원리를 강조하는 기관분립형 구조하에서는 단체장의 권한을 침해하는 것이 되어 법적근거를 마련하기에 어려움이 있다. 그러나 경기연정은 현실정치의 여러 가지 어 려움을 극복하기 위하여 제시되었고, 성공적이라는 평가만 존재하는 것은 아니지만, 협치라는 측면에서 대안으로서의 역할을 분명히 하였다. 이러한 정치적 실험이 현행 지방자치법 의 규정으로 인하여 지속될 수 없다는 점은 매우 아쉬운 요 소이다. 지방자치는 지방의 자원을 활용하여 지역발전을 도모해야 한다. 이를 위하여 그 지역의 정치 경제 사회 문화적 특수성을 반영할 수 있는 지방의 기관구성이 가능해야 함은 당연하다. 지방자치법 이 이러한 지역적 특색을 무시한 채 획일적 인 기관구성을 함으로써 일어나는 폐해가 적지 않으므로, 개헌을 앞둔 시점에서 지방자치법 의 바람직한 방향으로의 개정도 고려해야 할 것이다.

영문 초록

A new form of political experiment is currently being conducted in Gyeonggi Province. It is a local political system called the Kyung-gi coalition . It is said that it is an attempt to end the fight between the ruling camp and the communication through dialogue and compromise. There have been some studies in the political or administrative area, evaluates the performance of the Kyung-gi coalition and determines whether it is sustainable, but none of the studies have been evaluated and analyzed in the law area. At this point, it is necessary to examine the Kyung-gi coalition in the aspect of legal framework.-review the legitimacy and validity. It is also said that is in the middle of overcoming the limitations of Majority Democracy and moving toward consensus democracy. Under the current law framework-divided model, it have some good effect to solve political bias caused by different political tendency and entities. This is a very positive element for Kyung-gi coalition and it must be continued. However, Local Autonomy Act and current precedents are not favorable for this kind of formation of local governments. Actually, the local autonomy Act does not explicitly mention the relationship between local autonomous bodies of local governments, but the court clearly asserts that the structure of the local autonomous body structure is a rigid separation structure. Ultimately, I think there should be a change in the attitude of these precedents. Further, Local Autonomy Act should be opened to enable each local government to choose an institutional structure considering the characteristics of the region. There are some distinguishing factors in the Kyung-gi coalition. It is related to the confirmation of the deputy governor, the formation of a coalition committee and the confirmation of the heads of local public institutions. This paper provides a legal assessment of them. In conclusion, the Kyung-gi coalition is a form of organization that added to combined-organization model elements of current, rigid organization structure
