국문 초록

본 연구는 아동과 지적 장애인이 범죄 피해 이후 수사 또는 재판과정에서 진술한 내용의 신빙성에 대한 법관들의 평가기준을 성폭력 사건의 판례를 중심으로 확인한 연구이다. 그 결과 아동이나 지적 장애인 진술의 신빙성 평가기준으로는 진술의 일관성, 진술의 구체성과 합리성, 객관적 정황, 진술의 오염가능성, 폭로시점과 경위 등이 제시되었다. 요약하면, 첫째 피해자가 직접 경험하지 않고서는 진술하거나 표현하기 어려운 피해 당시의 상황 및 경위, 피해 사실의 핵심적인 내용, 횟수와 각 범행 사이의 간격, 당시 피고인이 하였던 말이나 행위, 범행 전후의 정황, 당시의 주관적인 느낌이나 감정 등을 비교적 구체적이고 논리적으로 일관되게 진술하였는지 여부, 둘째 보호자 등 제3자의 부정적 영향으로 오염, 왜곡, 편향되었는지 여부, 셋째 개방형 질문을 먼저 하여 피해자로부터 구체적인 내용의 진술을 이끌어내고 그 진술을 토대로 다시 질문을 하여 종전보다 구체적인 진술을 이끌어 내는 방식으로 자발적인 자유회상에 의한 진술인지 여부이다. 추후과제로 아동이나 지적 장애인 범죄피해 진술의 신빙성에 대하여 판단할 시에는 판례적 관점과 심리적 관점에서 어떠한 공통점과 차이점이 있는지 비교연구가 필요하다

영문 초록

In this study, we confirmed the judgment criteria of the judge about the credibility of the content of the child and people with intellectual disabilities after the crime damage in the course of investigation and judgment through domestic precedents.As a result, consistency of sentences, concreteness and rationality of sentences, objective situation, possibility of contamination of statements, exposure viewpoint and circumstances were evaluation criteria for determining the authenticity of sentences. To summarize, first, it is important to consider whether the victim stated in relatively concrete and logically consistent manner of following factors: circumstances at the time of damage that is difficult to represent or express without direct experience, important contents of the damage fact, the number of times and interval between each crime committed, words and actions victim showed during the damage, the circumstances before and after the crime, and the subjective senses and emotions at the time of damage. Second, the possibility of contamination, distortion, deflection by others including guardian, and third, whether the statement is brought by voluntary free recollection proceeded by open question first and re-question based on the answer to bring a sentence of more concrete content from the victim need to be considered. As a future task, when judging the credibility of a crime victim statement of a child or a person with intellectual disability, comparative studies are necessary to find out what common points and differences exist from the points of the precedents and the psychological point of view.
