중소기업 지원을 위한 토지법제의 과제

국문 초록

중소기업이 국가 경제에서 차지하는 높은 경제적 비중과 토지가 기업생산의 핵심 요소라는 점에서 중소기업 정책과 토지 정책은 높은 상관성을 보인다. 기업이 생산한 제품의 시장 출시 전에는 시장의 경쟁을 촉진한다는 점에서 국가의 광범위한 중소기업 지원이 가능하며, 시장 출시 이후에는 중소기업이 시장에서 공정한 경쟁을 펼칠 수 있는 환경을 조성하는 것이 사회 전체의 효용을 높일 수 있다. 이와 같은 관점에서 토지 정책은 기업의 생산에 직접적 영향을 미치는 만큼 적극적인 중소기업 지원 수단으로 활용될 수 있다. 다만 토지 정책은 토지의 효율적 활용과 국민의 삶의 질 향상이라는 본연의 목적을 해하지 않는 범위 내에서 중소기업을 지원해야 한다는 한계를 가진다. 중소기업의 공장설립에 대해서는 산업단지와 개별입지에서의 공장설립으로 나누어 각각 「산업입지 및 개발에 관한 법률」,「산업집적활성화 및 공장설립에 관한 법률」에서 규정하고 있다. 산업단지에서의 공장설립을 지원하기 위해 입주기업에 취·등록세 지원 등의 세제지원이 이루어지지만 이는 중소기업, 대기업에 모두 적용되며 중소기업만을 위한 지원책은 미비하다. 개별입지에서의 공장 설립은 「중소기업창업 지원법」의 ‘창업사업계획승인제도’를 중심으로 개별적인·허가사항을 일괄 처리하는데 중점을 두고 있다. 동 제도의 적용대상은 창업하여 사업을 개시한지 7년이 지나지 않은 중소기업으로 제한적이다. 일본에서는 공장설립에 대한 세제지원, 절차간소화 등의 지원책이 시행되지만 이는 중소기업만을 위한 제도가 아니다. 일본의 중소기업은 우리보다 높은 글로벌 경쟁력을 가지고 있다는 점에서 일본의 중소기업 지원제도를 직접 비교하기는 어렵다. 중소기업을 위한 토지 정책은 중소기업이 입주를 선호하고, 환경정책적 측면에서 효과적인 산업단지를 중심으로 추진되어야 한다. 이를 위해 산업단지에서의 중소기업 지원책을 확대하고, 수혜 중소기업을 확대할 수 있는 임대산업단지를 활성화할 필요가 있다. 또한 산업단지에서의 공장 매각 제한을 완화하여 중소기업의 경영 안정성을 높일 필요가 있다. 개별입지에서의 행정절차 간소화 대상을 기존 중소기업과 신생 중소기업을 차별하는 것은 합리적이지 않은 만큼 ‘창업사업계획승인제도’의 적용 대상을 모든 중소기업으로 확대해야 한다. 위의 개선책은 중소기업을 위한 토지 정책의 일부에 불과하다. 향후 저성장 고착과 대·중소기업간 양극화 해소의 큰 틀에서 중소기업 정책과 토지 정책의 역할 분담에 대한 추가적인 검토가 필요할 것으로 보인다.

영문 초록

The policies of small and medium-sized enterprises (SMEs) and those pertaining to land are closely correlated. This is because SMEs play a significant role in the national economy and land is a central factor in their production of goods. Governments can support SMEs in various ways to promote competition in the market before SMEs launch new goods. Following launch, the governments’ role is limited to protecting competition between companies. Changes in government roles according to competition lead to increases in the efficiency of society. Land policies are very helpful in this regard, because they directly influence SMEs’ production. Land policies have to be formulated with the aim of enforcing the development of national land and improving national welfare, rather than simply to benefit SMEs. Factory establishment acts can largely be divided into the Industrial Sites and Development Act and the Industrial Cluster Development and Factory Establishment Act. The Industrial Sites and Development Act provides benefits such as taxation support to large enterprises and SMEs for building factories in industrial complexes. However, the benefits for SMEs are comparatively small. The Industrial Cluster Development and Factory Establishment Act focuses on simplifying procedures involved in the establishment of factories by start-up companies on industrial sites. Land policies for SMEs have to emphasize industrial complexes meeting SMEs’ needs and contributing to effective environmental protection. Governments have to extend support to SMEs with respect to industrial complexes and developing SME-specific leases for industrial complexes. In addition, laws pertaining to the disposal of land and facilities on industrial complexes should be amended in order to relax restrictions therein. This would improve SMEs’ management stability. Furthermore, it is necessary to extend subjects of application from start-up to all SMEs to simplify procedures of establishing factory on industrial site. The above solutions are just some of those that can be derived from land policies for SMEs. Land legislation and policies should be reviewed from the perspective of collaboration between large enterprises and SMEs; significant changes in the commercial environment, such as the Trans-Pacific Partnership Agreement; and regulations pertaining to metropolitan areas.
