국문 초록

중재는 사법상의 분쟁의 해결을 사법기관에 의한 재판에 의하지 않고 당사자들의 합의로 정한 절차에서 그들이 정한 사인(중재인)에 의하도록 하는 것이다. 중재에 관해 규율하고 있는 중재법은 중재절차에서 활동하는 중재인의 자격에 관해 별도로 제한을 두고 있지 아니하다. 실제로 국내 최대 상사중재기관인 대한상사중재원 중재인들 중 비법조인의 수가 법조인의 수보다 많다는 점도 중재가 소송대체적 분쟁해결방안의 일종이라는 특성을 보여준다. 한편, 중재가 법원의 재판과는 다르다고 하더라도 사인간의 분쟁을 합리적이고 공평하게 해결하기 위해서 분쟁의 당사자들이 중재인을 지정하고, 그 중재인의 판정에 따라 분쟁이 종결되는 것이라는 점에서 중재인은 재판절차에서의 법관과 유사하다. 당사자들은 자신들이 지정한 중재인이 비록 법관은 아니라 하더라도 분쟁을 적정ㆍ공평ㆍ신속하게 해결해 줄 것을 기대한다. 그런데, 판사의 직무 및 직업윤리와 관련해서는 법관징계법과 법관윤리강령 등에서 일정한 의무를 부여하고 이를 위반할 경우 제재수단을 규정하고 있는 반면, 중재인이 분쟁절차에서 심판자로서 기대되는 의무를 위반할 경우에 대해 현행 중재법에서는 직접적인 제재수단을 규정하고 있지 않다. 다만, 중재인이 직무와 관련하여 행한 행위가 일정한 죄에 해당될 경우 형사법적으로 처벌되거나 그로 인한 손해에 대한 민사상 손해배상책임을 부담할 뿐이다. 그나마 손해배상책임의 인정도 제한적인 경우 에 한정되어야 한다는 것이 다수학자들의 견해이므로 궁극적으로는 법관과 유사한 역할을 하는 중재인이 공정한 심판자로서의 역할을 하지 못할 경우에도 해당중재인에 대한 실효성 있는 제재방안이 없다 할 것이다. 이는 중재 및 중재절차의 성격이나 증가하는 국내외 상사거래에서의 분쟁해결방안으로서 중재가 선호되는 추세라는 점 등을 고려해 볼 때, 중재절차에서 중재인의 공정성 등이 보장되지 못하는 경우에 소송 대체적 분쟁해결 방안으로서의 중재절차의 활용가능성 증대를 기대하기 어렵다는 문제에 봉착하게 된다. 이에 이 글에서는 대한상사중재원 중재인을 중심으로 한 중재인의 법률상 지위 및 의무와 현행법상 의무 위반시 조치에 관해 살펴봄으로써 법관과 유사한 중재인의 공적 기능에 주안점을 두어 중재법에 법적 강제력이 없는 현행 중재인윤리강령을 비롯한 중재인의 윤리적 의무를 중재인의 행위규범으로 명시하고, 나아가 중재인의 의무 위반시 직접적인 제재방안을 규정하여 중재인의 의무를 단순한 도덕적ㆍ윤리적 책무에서 법적인 의무로 개선할 것을 제안한다

영문 초록

Arbitration process is done by an arbitrator(s) appointed by the arbitration agreement of parties, not by the court of the nation. The Arbitration Act of Korea(hereinafter referred to as “Arbitration Act”) does not address qualifications to be arbitrators. In practice, the pool of arbitrators belonging to the Korean Commercial Arbitration Board(hereinafter referred to as “KCAB”) shows the outweighing number of non-lawyers arbitrators. Arbitration is one of the Alternative Dispute Resolutions which is mostly commonly used to resolute the commercial legal disputes among the parties. Given that the arbitration is primarily processed by arbitrators appointed by the parties to deal with the case being disputed and the arbitrators make a decision in the form of arbitration award, the role of arbitrators is similar with that of judges. Parties expect the arbitrators to act fairly and impartially. However, there is no direct legal grounds of disciplinary actions of arbitrators in the Arbitration Act, while judges are disciplined in accordance with the Disciplinary Act of Judges of Korea and Legal Ethics of Judges when they act unethically. Hence, it is no easy task to discipline arbitrators who violated the duty of care, duty of acting fairly and judicially, duty of acting with due diligence and duty of confidentiality. The only method to be guarantied by the Arbitration Act is to challenge the arbitrators. But the refusal does not work effectively to deter the unethical action of the arbitrators. Such arbitrators may be punished as certain crimes and/or torts under the exceptional circumstances. To promote arbitration as the most effective dispute resolution, the guaranty of fair and impartial arbitrators in the arbitration procedure would be a primary issue. This paper examined legal status and duties of arbitrators with focus on KCAB, and provisions in the current Arbitration Act and other applicable laws. And then, this paper suggests the Arbitration Act be revised to reflect the necessity of duties of arbitrators being enforceable ones just from ethical duties.
