지리적 표시 제도를 통한 전통식품의 수출활성화 방안 연구

국문 초록

지리적 표시 제도는 우리에게 그다지 익숙하지 않은 개념이지만 유럽에서는 100여년 전부터 논의되고 활용되어 오던 제도로서 저명도를 얻은 농산물 또는 그 가공품의 ‘명칭’을 보호하 자는 목적을 갖고 있다. 따라서 오랜 역사와 전통을 가진 국가를 중심으로 발달하였다. 우리나라는 가발을 주로 수출하던 국가에서 반도체를 거쳐 마침내 문화콘텐츠, 전통식품을 수출하는 국가로 성장하였다. 특히 우리의 전통주 막걸리는 세계주류시장에 내놓아도 전혀 부족하지 않은 차세대 수출품목이다. 그래서 이러한 특화된 수출품목을 보호할 수 있는 법제도로서 지리적 표시 제도를 제시할 수 있다. 현행 지리적 표시 제도는 큰 차이점 없이 이원화되어 있어 신청인에게 이중의 부담을 지우고 있기 때문에 개선방안이 필요하다. 개선방안으로서 이원화 되어 있는 지리적 표시 제도를 특허청을 중심으로 일원화 하고 농림수산부는 업무협약의 방식으로 사후관리를 담당하는 방안을 제시할 수 있다. 그리고 표시 제도의 개선과 함께 홍보를 행해야 할 것을 제시할 수 있다. 농수산물 및 공산품에 지리적 표시 제도가 사용되는 경우 생산자뿐만 아니라 소비자에게도 지리적 표시 제도의 홍보가 필요하다. 이는 소비자가 지리적 표시 제도에 대하여 알 수 없을 경우 국내시장에 납품하는 생산자는 지리적 표시 제도를 활용할 이유가 없기 때문이다. 국가 간의 거래가 활발해지고 우리도 다양한 가치가 내재되어 있는 품목을 수출하는 만큼 우리의 제도도 함께 나아가야 할 것이다.

영문 초록

Korea is growing up from wig-exporting country to semiconductor-exporting country. And these days, Korea exports cultural content and traditional food. Korea exports not only these items but also expanding exports ranging and the amount of export. Especially Korean traditional liquor, makgeolli is next generation export item. So it is important to support it with legal system. We pay attention to geographical indication system. Present dualised geographical indication system impose a heavy burden on petitioners. Geographical indication system is crucial to protect Korean export item including agro-fishery products and industrial products. Infringement on the right of Korean export items such as makgeolli and kimchi is currently underway. It is burning problem. So in this study, we suggest improvement plan of geographical indication system. First, geographical indication system should be unified with the Patent and Trademark Office. And Ministry for Food, Agriculture, Forestry and Fisheries should offer follow-up service. It is hard work, but it is urgent. In addition, lots of studies should be conducted and top-level human resources should be trained. The registration and management system of geographical indication system should be established, too. The most important thing is publicity. Especially geographical indication system shoud be promoted to consumers as well as producers. As we know in Budweiser case in America and Czech, we have to vitalize geographical indication system to take the advantageous position first. The laws aid the vigilant, not the negligent. With lively trades among countries, Korean geographical indication system should go further.
