환태평양동반자(TPP)협정 위생검역챕터의 분석과 평가

국문 초록

이 글은, 우리나라가 향후 환태평양동반자(Trans-Pacific Partnership: TPP) 협정 (“TPP협정”)에가입하기위한협상을준비함에있어특히유의해야할법적․정책적시사점을고려하면서, 우리나라 위생검역(SPS) 제도의 운용에 영향을 미치게 될 TPP 위생검역챕터의 주요 내용을 분석하고 평가하였다. TPP 위생검역챕터(제7장)는기존의세계무역기구(WTO) ‘위생검역협정’(“SPS협정”)과자유무역협정(FTA) 위생검역규정 상의 공약을 단순히 재확인하기 보다는 ‘SPS협정’에 기초한‘새로운 의무’를 대폭 추가하였는데, 이러한 새로운 의무에는 ‘SPS협정’보다 의무준수 수준이 대폭 강화된 ‘WTO plus’ 성격의 절차규정들이 다수 포함되어 있다. TPP 위생검역챕터는 인간이나 동식물의 생명 또는 건강을 보호하기 위해 필요한 조치를취할당사국의권리를인정하면서, 과학에입각한위생검역조치가‘투명하고예측가능하고 비차별적 방식으로’ 개발되고 이행되도록 보장할 의무를 부과하고 있다. TPP 위생검역챕터는 객관적인 과학적 증거가 결여된 수입국의 자의적이고 부당한 위생검역규제를 금지함으로써 자유무역과 무역원활화를 증진시키고자 하는 농산품 수출국의 이해를 보다 많이반영하였다. TPP 위생검역챕터는 지역화․동등성․투명성에 관한 SPS 위원회의 관련 지침 고려의무,수출국의 책임기관 및 관련 검사제도에 대한 수입국의 감사권 등에 있어 새로운 권리․의무 확대, 위생검역규정의 조화와 일관성 보장, SPS 규정의 효과적인 이행을 위한 투명성강화, 당사국과이해당사자들간의위해성소통의무강화, SPS 규정의집행력강화, 화해지향적인 분쟁해결방식 강화 등 여러 측면에서 기존의 ‘SPS협정’과 FTA 보다 무역원활화 측면이 보다 강화된 협정이라 할 수 있다. 식량수입국인우리나라의입장과 수입산식품의안전에 대한국민적우려와 관심을고려해볼때, ‘TPP협정’에의가입협상이개시될경우특히위생검역챕터분야에서대내적협상은 물론 대외적 협상과정에서 많은 어려움이 야기될 것으로 예상된다. 향후 우리나라의‘TPP협정’ 가입에 앞서, 정부당국은 SPS 정책을 국민 모두가 신뢰할 수 있도록 투명하게운용하고, 위해성분석을 효과적으로 수행할 수 있는 인적․물적 자원과 기술적 능력을 제고하는데 만전을 기해야 할 것이다.

영문 초록

This article analysed and assessed main contents of the sanitary and phytosanitary(SPS) Chapter under the Trans-Pacific Partnership (TPP) Agreement which might affect the operation of SPS system of the Republic of Korea, taking into account legal and policy implications to be regarded specially in preparing the negotiation for accession to the TPP Agreement. The SPS Chapter 7 of the TPP Agreement adds lots of new obligations that build on the WTO SPS Agreement rather than simply affirming the commitments of SPS Agreement and existing FTAs. These new obligations include many procedural provisions with WTO plus nature which strengthen the level of compliance than the SPS Agreement. The TPP SPS Chapter articulates new rules that Parties must ensure that science-based SPS measures are developed and implemented in a transparent, predictable and non-discriminatory manner, while at the same time recognizing rights of Parties to take measures necessary to protect human, animal or plant life or health. The TPP SPS Chapter reflects much more the interests of agricultural products-exporting Parties to improve free trade and trade facilitation, by requiring that SPS measures, lacking of objective and scientific evidence, do not arbitrarily or unjustifiably discriminate between Parties. With a view to stepping up trade facilitation much more than in SPS Agreement and FTA, the TPP SPS Chapter requires that Parties consider relevant international standards or guidelines adopted by SPS Committee in connection with regionalisation, equivalence and transparency, have the right to audit the exporting Party’s competent authorities and associated or designated inspection system, ensure the harmonization and consistency of national SPS regulations, improve transparency to implement effectively SPS regulations, improve risk communication between Party’s competent authorities and stakeholders, strengthen the enforcement of SPS regulations, and use much more power-oriented dispute settlement mechanisms like Cooperative Technical Consultations (CTC). In due consideration of the position of South Korea as a net-food importing country and concerns of the public about food safety of imported foods and agricultural products, South Korea will get much difficulty in carrying out domestic negotiation and international negotiation especially in the field of SPS Chapter, during the negotiation for accession to the TPP Agreement. Before joining the TPP Agreement, the competent authorities have to improve, therefore, transparency of SPS policy and system in order to ensure credibility from the public, and make best efforts in enhancing human and physical resources, and technical capacity which can be used to carry out effectively risk analysis.
