국문 초록

USTR이 발간한 ‘2004 Special 301 Report’에서 우리나라는 지적재산권 분야의 ‘우선감시대상국’(the priority watch list)으로 지정된 바 있다. 이는 우리나라의 경우 저작권을 포함한 지적재산권의 보호가 아직까지 미흡하다는사실을 보여주는 것이다. 기술적인 측면에서 음원의 불법복제 근절이 어려움에도 불구하고 음악인과 음원제작자가 MP3파일을 음악 유통의새로운 매체로 받아들인 이유는 온라인 유통이 기존의 오프라인 거래에 비해 소비자뿐만 아니라 음원권리자들에게도이득이 되기 때문이다. 온라인 거래는 유통구조의 단순화를 통한 음원가격의 하락, 음반의 과잉 혹은 과소생산의 문제 해결, 음반의 직접구입에 따른 구매비용 감소, 음악인의 양적 확대 및 다양성의 증가 등 여러 측면에서 오프라인 거래보다 우월하다. 하지만, 아직까지 우리나라는 온라인 음악의 유료 거래가 활성화되지 못했기 때문에, 이러한 이득이 현실화되지못하고 있다. 여기서는 향후 우리나라 온라인 음악산업이 발전하기 위해서 해결되어야 할 문제점들을 지적하고 정책적 방향을 제시한다.

영문 초록

Korea was included on the priority watch list in the intellectual property section of the 2004 Special 301 Report published by the Office of the United States Trade Representative (USTR). This in essence means that Korea has failed to properly protect intellectual property rights, including copyrights. Online trading is in many ways superior to the offline variety. Some of the advantages of online trade which can be enumerated include the lowering of the cost of phonograms as a result of the simplification of the distribution structure ； the resolution of the problems stemming from an excess or shortage of sound recordings being produced ； the decrease in the cost of purchasing music due to the ability to purchase music directly ； and the quantitative expansion of musicians as well as the increased diversification of music. However, the slow pace at which the commercialization of online music has advanced in Korea has meant that the potential benefits of online trade have yet to be reaped domestically. With this in mind, this study attempts to point out the major problems related to the Korean online music industry and introduces the tasks which must be carried out at the policy level in order to assure the industry’s future development.
