지방의회 의원의 보수체계에 대한 비판적 고찰

국문 초록

우리나라는 현행헌법인 1987년 헌법에 이르러 비로소 지방의회의 구성에 관한 유예규정이 철폐되고, 1991년 비로소 각급 지방의회가 구성되게 되어 오늘에 이르렀다. 그러나 어렵게 성립된 우리의 지방의회를 둘러싸고 그동안 여러 가지 많은 한계성이 지적되어져 왔으며, 그중에서 특히 당초의 지방의원의 무보수인 명예직에서 2005년 지방자치법 개정을 통하여 지방의회 의원에게 지급되는 보수에 관하여 많은 문제가 노정되어 이는 결국 지방의회가 지역주민들의 비난의 대상으로 전락되고 마는 계기가 되고 있다. 현행 지방자치법 제33조는 지방의회 의원에게 의정활동비와 여비, 월정수당을 지급하고 있는바 그 타당성과 투명성에 대하여 많은 의문을 제기되어지고 있어, 이러한 지급비용의 법적 성격이나 그 적정성 및 지급절차 등에 대한 법적 구명이 절실하다 할 것이다. 다시 말하여 의정활동비가 그 지급취지에 합당하게 사용되어지는지, 여비 특히 국외여비가 과연 필요하고 그 절차는 적절한 지, 월정수당 지급은 타당한지 등에 대해서는 지방자치의 취지라는 관점에서 재검토되어야 할 것이다. 이에 대한 엄격한 규제를 하고 있는 외국과는 달리 우리나라는 그에 대한 입구규제나 출구규제가 매우 미흡하다고 생각된다. 여기서는 우리 지방의회 의원의 보수체계를 선진외국 특히 일본의 보수체계와의 비교고찰을 통하여 그 문제점을 평가하고 바람직한 지방자치법 개정의 구체적인 입법론적 방향을 제시하여 보고자 한다. 특히 지방자치법상 구분하고 있는 광역지방자치단체와 기초지방자치단체의 지방의회 사이의 실질적 차이를 직시하여 지방의회 의원의 보수체계에 있어서도 그에 상응한 구별이 필요하다고 보아, 기초지방자치단체의 의회 의원에게는 월정수당와 여비 지급을 삭제하고, 이에 대신하여 회기수당과 비용변상의 지급만을 하도록 하는 입법론을 제안하고자 한다.

영문 초록

In Korea, the Constitution of 1987 repealed the moratorium on the composition of a local assembly, and thereafter in 1991, local assemblies were formed. However, many difficulties have been addressed over local assemblies. Among them, some critical problems related to the remuneration for members of local assemblies have been raised through the amendment of the Local Autonomy Law in 2005, which eventually became the local assembly to fall into the criticism of local residents. The Article 33 of the current Local Autonomy Law has brought up many questions on the validity and transparency of assembly activity fee, travel costs, and monthly allowances for local assembly members. It is, therefore, inevitable to reveal the legal nature of such payments. Specifically, it should be reviewed in terms of the purpose of local autonomy: ie., whether or not the assembly activity fee is appropriately used for the purpose of payment, whether it is necessary to travel costs, especially overseas travel costs, and whether the procedure is appropriate or the monthly allowance payment is reasonable. Unlike foreign countries, in which those respects are strictly regulated, Korea is on its line with having insufficient entry regulations and exit regulations. The present study seeks to evaluate the problem gravitating around the remuneration system of local assembly members by comparing it with the remuneration system of advanced foreign country (ie., Japan), and suggest a concrete legislative direction of desirable amendment of Local Autonomy Law. In particular, it is necessary to distinguish basic local government from metropolitan local government basic local government, which is classified by the Local Autonomy Law. The proposed legislation by the current study as follows: it is to remove the monthly allowances and travel costs and only to allow for the payment of session allowances and expenses in case of basic local assembly members.
