국문 초록

촛불혁명과 대통령 탄핵 이후, 한국사회의 근본적 개선방향에 대한 시민사회와 정치권의 접근방식은 차이를 보인다. 시민들은 헌정의 정상화와 사회의 근본적 변화를 위하여 촛불을 들고 광장으로 나왔고, 그 결과 신임을 잃은 정부수반을 파면하였다. 이는 우리사회에 새로운 헌법적 질서를 논의할 기회, 즉 ‘헌법적 모멘텀’을 가져왔다. 국회는 개헌특위를 통해 정부형태 개편을 포함한 개헌안을 마련하여 조속한 시일내 개헌을 추진하고 있지만, 시민들 대부분은 성급한 개헌논의에 대하여 비판적이다. ‘국민에 의한 혁명’과 ‘국민이 없는 개헌’의 역사가 또다시 반복되려 하고 있기 때문이다. 민주주의국가의 헌법은 주권자인 국민의 문서이고, 국민의 참여로 정당성을 획득한다. 더욱이 국민에 의해 추동된 헌법적 모멘텀에 부합하는 헌법개정은 국민에 의하여, 국민의 의사를 반영하여 이루어져야 할 것이다. 이 글에서는, 2008년 금융위기로 인하여 닥친 국가적 위기를 경제적ㆍ정치적 구조개혁과 사회적 가치의 재정립을 통해 극복하고자 하였던 아이슬란드의 사례를 소개한다. 아이슬란드 국민들은 사회의 근본적 변화를 위하여 시민이 직접 참여하는 헌법개정을 추진하였다. 이 과정에서 사회의 근본적 가치와 새 헌법에 들어갈 내용에 대한 합의에서부터 헌법개정안의 작성에까지 일반 시민들이 적극적으로 참여하였다. 특히 헌법안을 심의하고 작성하는 단계에서는, 전세계에서 최초로, 인터넷과 소셜미디어를 사용하여 시민들의 의견을 반영하는 ‘크라우드소싱 방식에 의한 헌법개정’을 시도하였다. 아이슬란드가 집단지성에 대한 믿음을 가지고, 첨단 인터넷통신기술을 활용하여 새로운 헌법적 실험을 전개한 과정은, 현재 한국에서 진행되고 있는 - 시민이 배제된 - 개헌논의에 여러 시사점을 준다.

영문 초록

Concerning political and social reform of Korean society after the ‘Candle revolution’ and impeachment of a president, the civil society and the political sphere show different approaches to the problem. The people (or citizens) assembled and marched with candles in their hands on the square longing for constitutional government and better society, and consequently, the head of government who lost the people’s trust was removed from the office. This brought our society an opportunity to discuss the new constitutional order - in other words, we encountered a ‘Constitutional momentum’. The Special Committee on the Constitution, which was constituted in the Parliament at the end of last year, tried to proceed a quick process of constitutional amendment whereas most citizens are not in agreement. So the history of ‘revolution by the people’ and ‘constitution-making without the people’ is about to repeat itself. Constitutions in democratic countries are people’s documents and therefore gain legitimacy by people’s participation in the constitution-making process. Moreover, constitution-making in accord with the constitutional momentum driven by the people should be accomplished by the people and for the people. This paper introduces the Iceland’s constitution-making case after an economic crisis in 2008. Confronting unprecedented financial crisis and inefficient action by government, Icelandic people were deeply disappointed with political elites and looked back on the ground of the society, and then they decided to make a new constitution for re-establishment of social values. Many people participated in the process of constitution-making, from the very first step to decide what were the most important values in the country and should be included in a new constitution and then they participated also in the next step to produce a draft. The most innovative and revolutionary point in democratic perspective in the process was that the draft for a new constitution was written with direct participation of its people for the first time in history. The internet and social media made it possible to make a crowdsourced constitution. The Iceland’s constitutional experiment, which combines the trust of collective wisdom with internet communication technology for constitution-making, is full of suggestion concerning current discussion of constitutional amendment - without citizens - in Korea.
