체류관련 출입국관리법의 문제점

국문 초록

현행 출입국관리법의 국내체류 외국인 관리에 관한 규정은 많은 문제점을 안고 있다. 외국인 체류와 관련하여 가지고 있는 가장 큰 문제점은 출입국관리법에 체류자격과 체류기간의 상한을 직접 규정하지 않고 포괄적으로 하위법에 위임하였다는 것이다. 그러나 체류자격과 체류기간의 상한은 출입국관리법의 본질적인 내용으로 입법자가 직접 출입국관리법에 법률의 형식으로 규율하여야 한다. 여기에 더하여 위임기관도 현행 출입국관리법 제10조에 따르면 외국인의 체류자격은 대통령령으로 규정하도록 하고 있고 체류기간의 상한은 법무부장관령으로 규정하도록 한다. 그러나 외국인 체류자격과 체류기간을 각각 다른 기관이 규율하게 함으로써 체류자격과 체류기간의 상한에 관한 규정이 체계적으로 규율되지 못할 위험이 있다. 이러한 문제를 해결하기 위하여 체류자격과 체류기간의 상한을 출입국관리법에서 대강을 정하고 단일한 하위법에 위임하여야 한다. 현행 출입국관리법은 영주자격에 관한 규정이 없다. 그러나 영주자격은 외국인의 체류관리와 관련된 사항임으로 출입국관리법의 본질적 영역에 해당하는 사항이다. 그리고 영주자격을 얻기 위한 요건은 국적을 얻기 위한 요건과 거의 동일하다. 또 영주의 체류자격은 공직선거법이나 재한외국인 처우기본법에서 이미 법률의 형식으로 규율되어 있다. 따라서 출입국관리법에 영주에 관한 규정을 삽입하여야 한다.

영문 초록

The current articles on the management of foreign residents in the immigration control act have many problems. This study is prepared to indicate the problems in order to revise the relevant provisions in the immigration control act. Although the number of foreign residents in Korea is annually growing by 6%, but the development speed of the immigration control act is not follow it. The biggest problem in the current immigration control act is in relation to the stay of foreigners that the sub-laws of the immigration control act are not organized systematically. According to Article 10 of the immigration control act, the status of stay shall be prescribed by Presidential Decree, on the other hand, the maximum period for each stay shall be prescribed by the Ordinance of the Minister of Justice. But legislators do not provide any limits or the concrete scope specifically defined in Article 10 of the immigration control act. Therefore Article 10 of the immigration control act violates Article 75 and 95 of the Korean Constitution. It is suggested that the immigration control act shall prescribe briefly the status of stay and the maximum period for each stay and then delegate to President to issue presidential decrees concerning them. There are no provisions concerning the permanent resident visa in the immigration control act. But the person with the permanent resident visa is recognized to have similar status compare to nationals. And conditions for obtaining a permanent resident visa is similar to the conditions for obtaining citizenship. Therefore provisions concerning the permanent resident visa shall be legislated in the immigration control act.
