한국의 학교 외의 시민교육 제도화를 위한 민주시민교육지원법안의 한계와 개선방안

국문 초록

2015년 대한민국 국회에 두 가지의 민주시민교육지원법안이 제안된 것에서 알 수 있듯이, 학교 외의 시민교육 법제화는 한국의 시민교육 제도화에 있어 중요한 문제이다. 이 연구는 민주시민교육지원법안을 분석하여 한국의 학교 외의 시민교육 제도화를 위한 개선방안을 제시하는 것을 목적으로 한다. 시민교육 제도화의 필요성은 현재 한국의 법제는 학교 외의 시민교육을 위한 체계적인 지원이 부족하다는 문제점에 기인한다. 비록 2015년에 제안된 두 가지 민주시민교육지원법안을 포함하여 시민교육과 관련된 과거의 법안들이 유사한 입법 목적을 가지고 있지만, 구체적인 부분에 있어서는 중대한 차이점이 존재하는데, 일례로 학교 외의 시민교육에 있어 적합한 추진기관 결정의 문제를 들 수 있다. 2015년에 제안된 민주시민교육지원법안의 근본적인 한계는 중앙선거관리위원회, 행정자치부, 한국경영자총연합회 등 관련되는 기관들의 이해관계를 동시에 충족하기가 어렵다는 점에서 초래된다. 관련되는 기관들에 의해 제기된 핵심적인 문제들이 이 연구의 법적 분석을 통해 검토가 되었다고 볼 수 있지만, 한국의 학교 외의 시민교육 법제화를 위한 개선방안이 첫 번째로 시민교육의 기본 원칙과 목표, 두 번째로 시민교육의 개념과 정의, 세 번째로 시민교육의 추진 주체라는 근본적인 합의 의 관점에서 제시되었다.

영문 초록

As two drafts of the Democratic Civic Education Support Act were presented at the Korean National Assembly in 2015, the legislation on civic education outside school is a core issue in the institutionalization of civic education in South Korea. This study aims to examine the drafts of the Democratic Civic Education Support Act in order to suggest the developmental directions for the institutionalization of civic education outside school in South Korea. The necessity of the legislation lies in the problem that the current legal system of South Korea lacks the systematic support for civic education outside school. Although the former drafts regarding civic education in the past, including two drafts of the Democratic Civic Education Support Act in 2015, have similar objects, there are significant differences in details such as the issue of the optimal organization in charge of civic education outside school. The fundamental limitations of the drafts of the Democratic Civic Education Support Act in 2015 come from the fact that it is difficult to meet the interests of the stake-holders, such as the National Election Commission, Ministry of Public Administration and Security, and Korea Employers Federation. Although the core issues, which were raised by the stake-holders, could be resolved through the legal analysis in this study, the developmental directions for the legislation on civic education outside school were suggested in terms of three primary consensus about (1) the fundamental principles and goals of civic education, (2) the concepts and definitions of civic education, and (3) the optimal organization in charge of civic education.
